Nah, I just meant did they see the clip or you talked to them over the phone..... And what did they say about Jamie's road position before taking the right hand turn? He was quite clearly not following the rules of the road for making a right hand turn and was doing so in a manor dangerous to other road users. I don't see how they could miss this with their 90 years of experience.
It was the blantantly obvious offence commited by the Thai rider, the offence that slaps you squarely in the face. The offence of failing to keep as far left as practaicable. There was absolutely no reason whatsoever preventing the thai from obeying the law and traveling on the left side of the lane. Cut and dried, tagged and bagged guilty as you know what. Thanks for coming.
Jamie was clearly travelling on the left as per the law and was veering right to make a turn. No offences comitted by Jamie the Thai 100% broke the law.

Bullsh*t statement...
In spite of a potential series of political demonstrations, these will not have any impact if foreign governments do not issue "travel warnings" to their citizens.
The demonstration that took place last weekend was one example. Although riot police dispersed the protesters with tear gas and there were injuries, this did not affect the Kingdom's tourism prospects because foreign governments did not issue warnings against visiting Thailand.
Australia certainly did and I think two others. More spin from Thai media. The continued riots from 2006, 2010, floods 2011 and now 2012 not only stopped travel, but also insurance companies raised rates high enough to stifle business. The film industry cackled and stopped productions costing the country millions (USD, GBP & AUD). Wake up Thailand, you keep shooting yourselves in the foot. Imagine if you got it all settled, culled the corruption and actually educated the populace, what a fabulous rise to fame you would then have.
So is he saying, if foreign governments kept thier bloody mouths shut and did not warn thier citizens of potential hazards/dangers, then thing would be better for Thailand? dam_n those medling foreigners.

I have 20+ years experience attending and investigating vehicle collisions and from the footage I see nothing that the Australian could be charged with. (no helmet yes)
1. Driving without a m/c license
2. Endangering the life of a passenger (allowing her to ride without a helmet)
I'm betting if she had been wearing a helmet, she would still be alive. Doesn't that make it his fault?
In the UK or Australia letting her ride without a helmet would be 'manslaughter' or 'reckless endangerment'.
He would have been arrested and held in either country.
Who says he didn't have a licence? The passenger is over 16 so it is the passengers responsibily to wear a helmet, under 16 the riders responsibilty to ensure passenger has a helmet. Same as for seatbelts in a car.
Ran this past a few colleagues this afternoon including one from the Major Collision Investigation Unit (D.I/Prosecutor) and all of the same opinion the Thai rider is at fault. The Aussie would have no charges to answer. The Thai would be arrested and charged with culpable driving.
Try and pass the blame onto the Aussie all you like but you are whistling dixie.

And all of the above makes no difference whatsoever. He was in Thailand, so Australian or UK law doesn't apply.
Yes true and the Thai police had nothing to charge him with either or they would have done so. They were relying on a confession and didn't get it so they were left with diddly squat.

Just to point out in the UK it is the responsibility of the driver to ensure seatbelts and helmets on all.
As passengers aren't required to have licenses, they don't take the fall.

Don`t take my word for it. Watch the video yourself, the evidence doesn’t lie.I've watched the video. A speeding motorcyclist, trying to overtake illegally, plowed into the back of another motorcycle who did everything right except wear a helmet. You're full of it.
The first motorcyclist overtook on the left, as is correct when you are overtaking a right-turning vehicle. The second one tried to squeeze in between the right-turning vehicle and oncoming traffic, was going too fast, and killed a woman.
Again, stop trying to blame the victims.
I suggest you read my posts and watch the video again.
The first motorcyclist was using the motorbike lane and not the main part of the road to overtake the Australian from the inside. The second motorcyclist was traveling on the actual all traffic road when the Australian suddenly turned right. Although it appears the second motorcyclist was moving at speed, it has not been exactly confirmed as to what speed he was traveling or whether he was breaking the speed limit. I do think even if the second motorcyclist was not speeding, that he was traveling too fast and not allowing for an eventuality of someone pulling out in front of him. Maybe due to lack of experience and I never said in any of my posts that the second guy was entirely blameless, my point is that the Australian is mostly at fault here and that the police were perfectly in they’re rights to point the blame at him. And sorry, but I’m not convinced about the police trying to extort money allegation, as they were only doing their job.
I doubt that a tourist would have knowledge as to the Thai road layouts and the motorbike lanes, which is another reason why newbies are the cause of and have so many road accidents in Thailand.

(no helmet yes) What is the 1st very glaring and obvious offence committed by the thai rider? It is an international rule and offence not to abide by. The offence is "fail to keep as far left a practicable" Then you have the offences of Fail to keep left of centre and diverge when unsafe. A road rule designed to prevent such collisions.
What was preveting the Thai rider abiding by this rule, was there an obstruction on his left? I didn't see anything as other riders were travelling on the left and abiding by the law. The Thai rider has no defence for not doing so and if he had of abided by the law and travelled as far left as praticable then I do not see how this collision would have occured. Thai rider totally at fault.
What did the Thai Police charge the Australian with? Nothing and why, because they had nothing to charge him with, they needed a confession of wrong doing and without it they had zip, zilch nothing. They produced a confessional statement written in thai by someone who wasn't even a party or witness to the collision apparently admitting all guilt to who knows what, may have been for unsolved murders for all the guy knew. Once they had a signed statement then the negotiations in regards to payments to make any charges disapear and compensation could have started. If he was at fault then he would have been charged with or without a confession and proceeded to court but the BIB knew that they had absolutely nothing to stand up in court. Even a Thai court. The stations legal team would have also scrutinised the footage before the program went to air for any blame that could be attributed to the aussie.
Some on here are trying to depict the guy and his girlfriend, god rest her soul as your typical loud mouthed drunken, thong and chang singlet wearing aussie yobbo. How so very far off the mark some are. These were two well educated decent people. Nicole was graduating with honours in journalism and was already working as a sports reporter/commentator for a radio station and part of the team of one of the highest rating, if not the highest rating television sports shows in Australia (The Footy Show) which requires a certain image on and off the media scene. They were two people who came to Thailand for a romantic holiday before announcing thier engagement and not to crawl the gutters of Pattaya and throw up in the street.

He can't seriously push all the blame on the other rider, he pulled out from one one side of the road and cut across to the other without even looking behind to see if anything was coming and was at no point stationary. No indicator! when turning he was way off the correct place to be turning (one side of road to other!). He couldn't possibly be an experienced rider driving like that, does it say in the report if he has a bike license, no sound on this computer. Seems like the other guy was going to fast to react but to give him full blame is wrong, I don't know what the speed limit is on that section of road but lots of the other trucks and bikes travelling at a similar speed. I do think the ozzie guy could have easily prevented this by doing what any experienced bike rider does by always checking behind several times if necessary before turning. What was his rush it was a busy road. Maybe he was too focused on what was coming towards him or had a drink who knows. Would anyone just change lanes on a motorway without checking your mirrors, indicating and checking your blind spot. Did she die from head injuries? Didn't see any helmets on the cctv.
Just my opinion.
oh the BIB are in thier rights then to extort money and get him to sign something that he can't even read. Are you serious. Bloody farangs causing allm the dramas in Thailand again. Yeah I know if they had of stayed out of Thailand it wouldn't have happened thier fault.

It's clearly the other driver's fault but what I'm surprised about is that so many foreigners disregard safety when they in Thailand and not at home. If you know how the traffic is here then by gods use helmets. It might be speculation but she could had a fighting chance if she wore a helmet.
That is quite true. The disgusting part part is the corruption and criminal activity of the police who tried in vain to stitch up a farang in the place of a thai and extort money out of him. A brave guy who stood up to the corruption. The poor girlfriend, rest her soul worked for a top rating sports show on one of the major networks in Australia, a network owned by extreemly powerful and influential business men. If it was just the girl next door I would hate to think what would have come of it. Would the media and the network of run with the story? The poor guy may very well be sitting in a Thai cell, just another farang who had fallen into the trap and never to be heard of.

This is one thread that deserves to run and run until the authorities in Thailand get at the bottom of it and everyone involved in this sorry state are brought to justice.The accident is just that a fatal accident but what went on afterwards is there to be investigated.

My thoughts exactly, clearly criminal activity by the Thai police and a charge of culpable driving against the offender. But the thais wrote it off as purely an unfortunate accident and no one at fault. Would be very interesting if the other rider was a farang.

Thai police tried to blame boyfriend for woman's death
A Sydney man was forced to wait for six days in Thailand after local police allegedly tried to blame him for a motorcycle accident that killed his girlfriend, despite CCTV video proving he was not to blame.
Ms Fitzsimons, who was part of Channel Nine's Footy Show team, died three hours after the accident.
But Mr Keith said the trauma continued when local authorities took him to a police station about six hours after the accident and asked him to sign a statement written in Thai that said the crash was his fault.
"I was vulnerable and they were obviously after one thing and one thing only, it was my money. It was a way to bribe my way out of it," he said.

Does this mean that the Thai Smile doesn't come naturally. Is just another one of these false pirated copies that are common to the Thai way or the Thainess.
Maybe they could introduce a two tier pricing system too....seems crazy to charge rich farang the same price as poor thai people...
They already do that in some European countries. Thais living in those countries get special, lower prices when they visit Thailand, or at least that was the case a few years ago.
Same for thais when flying abroad, if they go into the Thai office and book a flight they get a 20% discount with thier I.D card. My wife does it when my son and wife fly with me to Aust. Thier fares are cheaper than mine.

Not totally sure, Guess he didn't score high enough marks on his exam to be accepted. They only accept those with the highest marks (Private school/Business) There were a large number of 4 yr olds applying and they had to sit a 2 hr exam on reading, writing and maths in both Thai and English. We started preparing him from the age of 2 and he can read and write in both languages and his maths are excellent. We even had him baptised catholic in preparation. I guess more tutoring required prior to starting school.
The private schools are purely a business and that is why they like thier students to already be fluent in reading writing (both thai/english) and maths before they start school for the 1st time. They can charge more if they have a better class of student, it's has nothing to do with education purely money and business. If they have bright students then they will claim the credit and use them for financial gain.

A ceasefire between Hamas and Israel has been agreed and is to be announced within hours, according to a Palestinian official. On Tuesday night, Hamas official Ayman Taha said an Egyptian-brokered truce had been finalised and would take effect from 10pm. But a spokesman for Israeli Prime Minister Benjamin Netanyahu said the announcement was premature.

Not sure if how solid is this, and there's still time for things to go wrong, as they so often do.
Local media on both sides had another take on how things will go - basically that Clinton will ask everyone to behave, Israel will accept and stop the attacks, then (willingly or under Egyptian pressure, not clear) the Hamas and Islamic Jihad will do the same. A more comprehensive agreement to be reached later on. Again, hard to judge how serious are these reports.
Re going-to-war-for-votes: Public opinion in Israel seems to be not overly supportive of a ceasefire under current conditions and according to this outline. If it goes through, might be some political price for decisions made. Two months are a lot of time in the Middle East, though... Palestinian public sees such an outcome as a major victory, what with no ground invasion and Hamas pumping some propaganda about downed Israeli aircrafts, Israeli casualties and direct hits. Guess some sane people on both sides also appreciate the chance for not having it all out this time around.
Foreign Minister Mohammed Kamel Amr of Egypt, which brokered the ceasefire after marathon talks, announced the cessation of hostilities at a joint news conference in Cairo with US Secretary of State Hillary Clinton.

It's more of a question of affordability, rather than out & out corruption.
Corruption in the true sense is when you try to sell the item swearing till your blue in the face that it's the "real deal"
Thais in the majority who are on a moderate to low income can only afford fake goods when talking about showing off a top label, so to are the "visiting farangs" who are just bargain hunting for an even lower price, fakes are part of Thai culture, until wages equal fashion prices then fakes will be prevalent.
You can't always blame China or other neighbouring countries either for forcing their goods over the border, in most cases you will find Thai business owners selling their fake goods to Thai consumers, both fully aware that they are fake.
Price dictates all in Thailand.
Agree everyone knows that so many things in Thailand are fake and it is the only way the general populous can afford them. I to have been guilty of buying pirated DVD's as I am sure so many others on here also have done.

I seriously doubt this has much to do with the Palestinian UN bid.
The Hamas isn't exactly supportive of the PA's move, and wasn't a major part (if at all) of the international effort concerning this.
When Israel goes against the Palestinians, the usual result on the international diplomatic front is increased support for the Palestinian cause. If anything, an invasion will improve the Palestinian chances of getting their way.
Not that savvy on the legal issue you brought up, but as far as I understand this goes both ways - might explain why the Hamas leadership isn't all that in favor. Either way, this doesn't seem to be a major issue from the Israeli point of view, rarely comes up in the media.
I have to agree Palastine is recieving growing international support not just politically but also from the man in the street. Israels constant actions and killing of kids is not wining friends.

I am well aware of the rules as it is my job and what I have been doing for years. I have looked at the video numerous times, even with fellow workmates and an expert in accident investigations and prosecutions. The Aussie guy would not be charged with anything the Thai rider would be charged with culpable driving. It is pointless arguing with sofa experts. Your case would be blown clear out of court and you would be made to look like a fool. Sorry but that is just the way it is.
