    Yep, at least they are inconsistent at all levels. I should have known not to expect anything different I guess! Anyway, this is just a worse case scenario for me, hopefully I will not have to visit the UK in the near future to ever find out their interpretion of the rules.

    OK. Thanks BritTim, for confirming that. Will not be travelling back to the UK anytime soon unless it's an emergency. 

  3. I'm about to switch the reason for my Extension of Stay from being based on Marriage to Retirement (there's another thread on this if you want to know why, sorry don't know how to link here!).

     

    On the London Thai Embassy Website  it says that you need to marrried to a Thai national, makes no mention of requiring a Non "O"/extension based on marriage, in order to apply for a Certificate of Entry. Just want to double check that this is indeed the case. Not planning to visit the UK, but just need to know that I wont be locking myself out of Thailand should I have to make a trip, by switching to a Retirement extension.

    Yes, false information from the Immigration Office in my case. Everyone needs to visit their own IO to find out for sure what their situation is.

I went to immigration early August to try the 60 day extension, but they refused that saying that it was over 60 days since stamp expired.     Only difference I can see is that my visa is still valid but the environment may have become more hostile than it was. They certainly seemed to take a dim view of the ME visa holders using the amnesty.

    More or less sorted thanks. I'm using an agent in Pattaya, who assures me that there won't be a problem. I dont mind paying this time, as they are saving me from a lot of stress and hassle that I dont need.

     

    I'll be using the Jomtien Office, apparenty if you live in Chonburi province you can use any Immigration Office in Chonburi. I cannot face having to return to the Si Racha Office and having to sit there while they tell me I'm an overstaying and the amnesty does not apply to me, while jabbing away with their finger at my expired permit to stay stamp. I didn't bother trying for the 60 day extension, as on a previous occassion separate to this they refused this extension, for the reason that "I was living with my and not visiting her"!

  5. Thanks for the support and empathy guys. I hope others in the same situation find their Immigration Offices more accommodating than mine.

     

    Nothing more to report, as wasn't able to make it to immigration on Friday. Will go Monday now, but given my previous experience I don't hold much hope that they will give me 60 days (to visit wife), but I can but try!

     

    I think it's more likely i will be using an agent to get me through this. So if any one can recommend one in Si Racha or Pattaya please pm me.

    Attend you office outline your plan to obtain 60 day extension to visit wife and then apply for annual extension marriage.

    If they say no problems (they should) then you can apply for 60 day on the spot.

    OK. Thanks DrJack. I'll go back there tomorrow to give this a try, but I'm wondering if this is an option, why they didn't suggest this themselves? I will give it a go though.

    There are other offices accepting applications from people in a similar situation as yours.

    Perhaps try to apply for a 60 day extension to visit your wife.

    Because at that time i did not have 400k in a Thai bank account to apply for an extension. As soon as I was able, I transferred the money into my account which was on the 11 July. Under normal circumstaces I would have left country and come back.

  9. I don't want to start another TM30 thread, so hope its OK for me to tag my qus onto this thread (as it's more TM30 confusion!)

     

    I recently spent the night at a hotel, they took my passport details, so I presume they will report my stay. However, the hotel was in the same province as my home address and I was away from my home for less than 24 hours. Was I meant to report my stay away to immigration on the TM30? (too late now, but I'd like to know, so that I'm prepared for when I do my extension of stay!)

    Other than that, man up and get your extension done. Otherwise you will be the one losing anyway (overstay, fines, more papers needed).
    What you state about your local immigration sounds weird to me, you can also just go to another office near by.

    Game! Why would I want to play any games with Thai immigration. I know the consequences, that's why I'm asing for the options available. As far as I know, you can only use your local immigration office, otherwise I'd be more than happy to go elswhere!

    My non-immigrant O obtained from KL a few months ago expires tomorrrow. I was due to fly out to Ho Chi Minh Ciy tomorrow to get another non-O (multi), but unfortunately I seem to have come down with the flu or simlar bug, so travelling is going to be difficult. Will my immigration office extend my visa due to illness? I'm guessing that they would need a letter from the Doctors if this is an option?

     

    I know that most immigration offices will give a 60 day extension for a non-O visa, but unfortunately this is not the case with my office (I have tried before).  They (Si Racha) have their very own interpretation of the regulations!

    Unfortunately, Vientiane is booked out for weeks ahead, so it's a no-go. 

     

    I've been thinking about trying Kuala Lumpur, but then I read a thread on this forum that mentioned that they do not issue non-O visas (for me based on marriage) if you are over 50! (I'm 51). Does anyone know if this is actually correct? Seems no logical reason for this to be the case, which makes me think that it might be true!

    Which office? That is certainly not required for the non immigrant visa application.

    It's the Si Racha Office. I specifically went into the office with my wife last month to check their requirements for the Non O visa and they insist on the 2 month requirement for the 400k (which is why they would not let me apply for the visa there and then). I tried to point out to them that I did not think this was the case, but they disagree. I've given up trying to argue the point with them!

    That’s correct for applying for the 1 year extension. But before you do that you need a non immigrant visa, and if you apply for that in country the funds only need to be in your account on the day you apply.

     

    Whatever you choose you’re going to need a non immigrant visa/entry. It’s usually far less hassle to apply for that outside of Thailand and would solve your concerns of being denied VE entry.

     

    I don’t think you will be denied, but take a copy of your marriage certificate, wife’s ID and Tabian Baan in case they do question your reason to visit.

    Back on topic, from what I have been reading, you might be pushing your luck looking for another visa exemption.  

     

    I was thinking of Phnom Penh, as my wife flies there often for work, so I can easily join her on one of her trips.

    Rather than getting a visa exempt entry it would be best get single entry non-o visa in Vientiane or Savannakhet.

    Or you could get one in Penang Malaysia by showing the 400k baht you have in the bank (no need for the 2 months).

    Before you apply for the extension you will need a non-o visa entry. You could of applied for one at immigration with the 400k baht in the bank since there is no requirement to have it in the bank for 2 months for the visa application.

    Yes, I've been thinking about Savannakhet, Laos. It's just a bit of a trek to go there and back (20hr+ travel time & overnight stay). My local immigration office insists that the 400k baht must be seeded for 2 months!

    At the end of the 60 days — as long as you have 15 (maybe 21) days left — you can apply for a non-immigrant visa if the 400K is in your account (no seasoning required). That will give you another 90 ish days; and you can apply for the 1 year extension within the last 30 days of that 90.

     

    Probably not. But if you’re going to leave the country again you’re best bet is to get a Single Entry Non ‘O’ Visa, which are available in the region without the need to provide financials. You’re going to need one prior to extending again.

     

    They would not let me extend for 60 days as they said that I was not visiting my wife, but that I was living with her (which is true). They insist that the 400k must have been in the bank account for 2 mnths!

     

    For the reasons I've given, I still think that flying to Phnom Penh and back will be the easiest option for me, but I really don't want to end up being refused entry. Will the fact that I am travelling with my wife give them less reason for me to be refused. I had thought that as I am arriving by air that I would be OK, but I am still unsure!

    I’ve been living in Thailand for the last 8 years with my Thai wife. I’ve mostly been staying here on a Non ‘O’ visa based on marriage, but at the end of last year I was unable to extend it due to financial reasons. I am presently here on an extension of my 2nd Visa exempt entry for the current year, obtained at the Cambodian land border crossing.

     

    I understand that I cannot enter Thailand again at a land crossing using visa exempt, but I can enter up to 6 more times by air. So, at the end of March when my extension expires my plan is to fly to Phnom Penh and back to Bangkok on the same day to get a further 30 days visa exempt entry.

     

    At this time I will then have had the required 400,000 bht in my Thai bank account for 2 months and can apply for the Non-O in Thailand. (I cannot apply at the moment as the funds have not been in my account for 2 months.)

    All I really want to know is, will there be any problems with me entering Thailand for the third consecutive time with on a Visa exempt entry, but this time via air? From what I’ve read there shouldn’t be, but I just want to double check!

    Thanks for your full answer. I'll double check with the local immigration office as to whether they need my marriage certificate legalized, hopefully not, as I don't have the old affirmation anymore!

     

    Just want to double check. I had my previous extension of stay extended by 2 months (no financial proof required), which they said they only allowed because I had not had this type of extension before. Will this extension prevent me from having the 30 day extension of my 30 day visa exempt entry?

    I’ve been extending my stay in Thailand for the past five years based on being married to a Thai wife (originally visa was a non-immigrant O). This year due to various reasons I didn’t extend my stay, but instead left the country for a visit to the UK and then returned to Thailand under the visa exempt rules and given 30 days stay.

     

    My first question is can I now go (before my 30 days are up) to my local immigration office to apply for a new Non-immigrant O Visa based on marriage if I have proof of income (40,000 THB credited for 3 separate months into a UK bank account)?  And will they give me 1 year or 90 days?

     

    Secondly, I remember having to get a letter from the UK Embassy confirming that my UK marriage certificate was valid, even though I had also registered the marriage at the local Amphur Office. Is this still a requirement?

     

    That just above covers all I need to know for now. Thanks for your help.
