The original post person for this thread on Blacklist I have pulled up on Imm database, his Nationality is Indian, which if stated in Post would explain everything, Blacklist can not be removed for African, Indian, Pakistan, Bangladesh etc

So it means no hope ? Even if my thai wife is appealing?

Personally, I wouldn’t get your hopes up to high that the ban will be rescinded no matter what your lawyer says.  As was indicated in your previous post (Court case over but black listed) it is going to be an extremely expensive of action in terms of lawyer’s fees and disbursements. Removal of entry bans are extremely rare.

If, and when, the ban has either been terminated, or finished, it is unlikely that immigration will provide you with a letter confirming that the ban has been lifted. Again this is something that they normally will not do.

Please also bear in mind that even if the ban is lifted/finished and you obtain a visa, there is no guarantee that you will be allowed to enter the country.  Entry is at the discretion of the IO at the 'port of entry'.  The moment the IO scans your passport, your history will appear on their screen and if the IO has got out of the wrong side of the bed that morning they could refuse you entry for any one of several reasons.

    Best of luck

    Thanx for ur advice

He set up a Thai company with fake (non-existent) nominees, perhaps for the purpose of home purchase, not sure. He was forced to stay here for trial, the judgement was against him and I believe that he also ran into some overstay issues due to confusion about the special extension for the trial and verdict.

I was not overstay even for single day

Getting a visa does not mean you're off the blacklist. Theres not much point applying until you've written confirmation that you're off the list.

Does the immigration and embassies dont share the same computer data base?

  7. I have been blacklisted by thai immigration and banned for 5 yrs. (i was living in thailand from last 25 yrs)

Now my thai wife has appeal in immigration against this ban and our lawyer has given us some hope.

My question is what happens after i get removed from blacklist( legally) do i get some papers from immigration office that i m not blacklisted anymore as i dont want to be in any big trouble at my arrival on svarnbhumi airport

Does to get non -o visa (marriage visa)means that i m not blacklisted in thailand anymore?

    Thanx eyeryone

That's a very interesting theory. The OP should come back and confirm, but he was discussing his court case in March last year - that's how I guessed the time frame. I would also think they had his passport the whole time as he would have been on bail.

No i was not on bail dear because i have paid the fine on the day 1st when court gives his verdict

There's no need to quarrel about what extension he was on. His original Non-O visa extension was cancelled and he was given a special extension limited to the date of his final court hearing. As soon as the court case was over, his special extension expired. At that point, he had to apply for a new non-O visa. Instead, they gave him the marching orders.

What the immigration officers failed to explain to him was that his eligibility for another visa would depend on the verdict in court. As a result, he was unprepared for the outcome. This is yet another example of bum information from an immigration officer.

Exactly that what has happened in my case

    Are you still here?

And now you're suggesting that one of the few people giving sound advice should "trot on"?

What is your problem? I'd tell you what it is, but unfortunately, forum rooms wouldn't permit it.

The OP came here for advice. I will be giving the OP a very good recommendation of the lawyer that did a superb job for me and won 2 court cases. I'm not sure how they will go, as the lawyer is in Pattaya and the OP was in Hua Hin, but he works the Bangkok court circuit too, which is possibly where this case may end up. It's quite possible that his wife could start a court case to help get her husband back. I don't see how he has lost his right to appeal just because he's been deported. The courts afford that right and it should be followed up. The court allows 30 days to appeal after the judgement, which can be extended 3 times. The fact that he's overseas will likely get him extensions. I would guess that if he makes an appeal they will have to let him back in. This is very complicated and he needs the best legal assistance he can get.

Yes you are right,,, pls email me your recommendation .   <contact by PM>

So you've been banned for a period and not blacklisted entirely, right?  Would I be right in thinking that this ban is because you got caught up in the court system and could not leave the country, subsequently overstayed your visa so the ban is technically for overstaying?  The reason I ask is because this is exactly what happened to a friend of mine.

No ,,, i was not overstayed even for a single day,,, i was on court case under consideration visa

  12. Hi guys;

To cut the story short i had a court case against me for fake nominess , the case is finished now, i mean i paid the fine last month and got the final paper from court that i have nothing pending against me.

I was told by the local immigration that when i get this final clearance paper from court i can bring my wife(THAI WIFE) to immigration office and i will be back to normal NON O visa, but to my surprise the day i went to renew my visa , i was still blacklisted with only 2 days to left my visa.

So they deported me with 5 yrs ban stamp on my passport

Guys my question is how can i go back to my family ( my thai wife and widow mother) legally.

Pls reply for the sake of humantity.

    God bless you all

If you are on a extension of stay is is not a visa) based upon marriage you got at immigration there would be no requirement to get an extension (not a visa) based upon litigation if you unless you are divorcing your wife. You could apply for a extension based upon litigation when your current one ends or another exention based upon marriage. If you got the 90 day extension based upon litigation you could still apply for an extension based upon marriage at the end of it.

If you have a multiple entry non-o visa based upon marriage issued by a embassy or consulate it would remain valid until it expires. If your current 90 day entry from it  is ending you could apply for an extension of it based upon litigation. Then when the litigation ends you would have to  leave and re-enter to get a new 90 day entry.

Thanx a lot for ur reply

The only reason to get the extension based upon being involved in litigation is because your current permit to stay is ending.

If you had a 90 day non immigrant visa entry the extension for litigation it would extend that entry. When the last extension based upon litigation ended and you could qualify for an extension of the original entry from the visa it could be extended. If not you would have to leave the country.

Thanx for replying, before court case visa i have a marriage visa so i will b not leaving country to get a new non o visa?

I would suggest that you carry a certified copy of the verdict and the letter that stated that the case is finished and there is no appeal pending with you if you want to leave Thailand.

And i have to come back too in thailand, i have family here, any problems to come back?

To the best of my knowledge, unless an order went out to immigration to block any attempt by you to depart the country, there is nothing special you need to do prior to leaving now.

Note that, although unlikely in your case, any offense for which you are arrested and convicted can, in theory, lead to your being blacklisted from returning. As I understand it, it is usually up to the official who arrested you whether blacklisting should be pursued for other than very serious crimes. I think a few here understand this in detail, and may be able to help you better.

    Thanx for replying

Normally if we have a court case and we have fully paid the fine, we are a free man in Thailand. But look like your case is more serious, can I know how much is your fine and any special endorsement in your passport? That maybe we all can figure out your answers.

Sent from my iPad using Thaivisa Connect

My fine was 400000bahts and not any special endorsement in my passport , in the mean time i was geeting court case under consideration visa
