    Congrats on the new baby! This points out what I was saying earlier, extenuating circumstances, including medical situations can jump you in the que. Another is impending contract start dates for employment, education course start dates etc... There is a fudge factor no matter what your agents and the like say. Like I said read your book, and read other visa classes as well.

  2. @dbrenn Thank you indeed for the information. I was not intending to avoid anything, I was just proposing a 'what if', and you have nailed the answer, thank you again, I hope you hang around the thread a bit.

    @Gopro Glad to hear it was sorted for you. We had the same, quick interview and Mrs Oz will start level 3 on the 2nd I think. There is some more in it though. As of this year (Jan 1) the program is now run by the Dept of Education, the SILPAT hours (the additional 240 of vocational training) has been scrapped or rather merged. If you are in a major city only, you were able to get these hours after finishing the level 3. Now you can get them as part of your 510 (300 odd English 200 odd vocational). I spoke directly with the AMEP coordinator, so this is from the horses mouth. Unfortunately, due to budget restraints, not all TAFE will be able to offer the SILPAT, where we are in rural Victoria it is just tough cookies. No money for the country! Once your spouse has enrolled, then they have 5 years to use those entitled hours anyway, so keep an eye on possible funding/course changes at your local TAFE.

    ATO is slow to come to the party with a taxfile number, but it can be done online now

    Definitely set up a MyGov account as soon as you can for all the management of this, it can be done before you get here even.

    We are now (this week) looking at certificate courses at RTO's, if anyone is interested in that information, I can pass it on.

    Will, give us your best qualified opinion. I think u could advice best rather than always knocking. How about some "suggestions" with a disclaimer "seek professional advice"

    I think I've given lots of advice on here, but if I see something I know is incorrect or

    in this case, some advice I don't agree with, I'm allowed to air my opinion.

    But because I've "called you out" on a few things and disagreed with you on occasion,

    you say "I'm always knocking".

    Waiver of 8503 has been discussed on here pretty regularly if you want to search for it.

    From DIAC: The circumstances in which the minister may waive [condition 8503] are:

    1. since the person was granted the visa that was subject to the condition, compelling and compassionate circumstances have developed:
      1. over which the person had no control
      2. that resulted in a major change to the person's circumstance

    I think the chances of getting a waiver are extremely thin.

    There has been no material change since the visa has been granted.

    In fact, DIAC, in this case have been more than reasonable by called fress313

    and asking them if they would like a 12 month visa as they have a partner application in.

    If you think that a waiver is possible, that's your opinion, I don't agree with it though.

    As far as putting in a disclaimer, well that's just a bit silly IMO.

    One of these conditions include a medical condition, she would only need a sympathetic doctor to say she could risk the baby by flying around a certain period and it would be done, in fact you can Google the appropriate information. The DIAC would not accept responsibility for not allowing her to stay and risking her or the babies life. Pretty easy isn't it?

  4. I suppose "Expire" is a harsh term. The PR doesn't expire, as such. What expires is the ability to re-enter Aus on that visa. The RRV (Resident Return Visa (re-entry Permit) provides permission to return and take up residence. Your right to live here permanently remains, its just a case of getting permission to come back once you've left.

    Citizenship:

    If you don't spend a total of 4 years living in Australia including the 12 months immediately prior to applying for citizenship you are not eligible for Oz Citizenship, after 5 years on the PR100 you will need to get an RRV. That is a whole new subclass, and fee.... smile.png You can travel 'Visa Free' (ie no RRV) as much as you like for 5 years, after which you will need an RRV to come back in.

    The baby will be born in Australia as my wife is here on. A 12 month tourist visa .
    Yes I know no Medicare and all that but we are covered don't worry .

    But does that help with us not needing the 2 year wait for the (100) visa

    I'm pretty sure that the condition of having a dependent child would have to be met at the time the application is made, not when the visa is granted. But I'm not 100% sure.

    I would suggest not. The straight trip to 100 usually comes from a long term relationship status AND kids. You will most likely go to a TR 309 or 809, then sit an interview at a later stage (2yrs from application) to then be granted a 100 PR. Your baby will of course have an Australian Birth Certificate, which just means you don't have to worry about getting it translated, that's about it.

    edit: The 2year period, if you minus the visa processing time is only just over a year anyway, in that time only 2 things are different from TR holders to PR holders, that is that PR holders get a Green Medicare Card, and MAY be eligible for some social security benefits straight away. The TR will get a BLUE Medicare Card, and is unable to claim benefit until their TR has been upgraded to PR 100, however if severe financial hardship is present, they also become eligible under 3 schemes for migrant assistance.

    The road to the NEXT STEP (Australian Citizenship) for all holders of the PR 100 is 4 years holding a PR visa, then apply for citizenship ($200 odd) and then you are done! The PR does expire by the way, contrary to some peoples thoughts.

    David.. when you fill in the form or get it filled for you, then on the form you are asked for which visa you are applying for (309/100 and 809/100) are sets to the same goal. If you qualify for the 100 you would be granted it straight up, if you do not then you would get a TR 309/809. And that would be able to be 'upgraded' to the 100 when your time is up (2yrs). All of us have applied for both at the same time, which one is granted as I said depends on your personal circumstances.

    To GoPro and Seabass , my belated congratulations. Mrs Samurai and I are packed and leaving on the 27th Dec., so only a few more days to go. Let the rest of the fun and games begin.

    This is another sad day, of endless islamic violence and terror. Most people, just get on with their day to day lives, and aren't in the slightest bit interested in religious bigotry. I sincerely hope that the innocent people who are being held hostage by this scum are released or rescued without casualty.

    It really is too late for that now to be honest, if they make it out without a scratch they still will be scared for life. Imagine the emotional trauma these people are facing right now! For NO REASON.

  10. Thanks for the info, it was written a long time ago and from memory. I was just saying to David that I needed to update the info here. I have done more research since.

    Let's sort the mess out first

    AMEP = Adult Migrant Education Program (part of the DIBP)

    AMES = Adult Migrant Education Services (School Name)

    RTO = Registered Training Organization

    SLPET =Settlement language pathways to employment and training program

    (an extra 80 hours to your 510hrs, with workplace emphasis, it's just more hours English tuition)

    AMEP is a body and a course

    AMES is one the institution that design/deliver the AMEP

    AMES with rare exceptions only operate in larger cities

    Step 1 is calling AMES to find out if your partner is eligible to receive the 510hrs of tuition. They will tell you directly yes/no

    AMEP courses are also offered at other institutions such as TAFE, if that TAFE has an AMEP qualified ESL teacher.

    IF you live in the major cities, AMES also offers, like all RTO's certificate courses, however they only MAY BE funded by the government and you would need to apply and be assessed, if not they are the same as any RTO, you pay.

    The fee is determined by your eligibility for Government funding. Download the Fee Schedule or contact AMES to check your eligibility for a concession fee.

    There may be extra charges for learning materials, first aid certificate, police check etc.

    At AMES Early Childhood and Aged care are available. Having said this, if you are outside the major cities, and can not attend an AMES facility then it is tough titties! You would apply to any RTO close to you and see if you are eligible for any government concessions. Most of the smaller RTO's do not know about this so unless you walk in with the details (who's paying) in your hand, they are not going to know what you are talking about and you will waste your time.

    Basically any RTO is a business, they only care where the money is coming from. If you can prove the government is paying or giving a concession then you could potentially do whatever course you please, wherever you please not just at AMES, they are just the primary provider of the AMEP.

    Some certificate courses require a pre-requisite of intermediate level English proficiency, all courses vary so going into it here would be pointless. This is where an approved AMEP course is useful. It is the equivalent of TOEFL, TOEIC and all those ESL quals that you can use in Australia.

    To be eligible for govt. funding for courses it would be assessed by Centerlink I would imagine, I have not gone that far yet as it needs to be sorted out on the ground, and will really depend on your personal circumstances. Assets, income visa type blah blah! Will update when I have our situation sorted.

    IN NUTSHELL: You are not entitled to anything except 510hrs of ESL training and maybe 80 more if needed (SLPET). Any certificate courses etc.. are out of the realm of AMEP funding. That's why they put the E in AMEP!
