I went straight to the border there last April with both passports in hand and was promptly sent to the Kap Choeng office for them to do the transfer,
So take ubonjoe's advice and stop at Kap Choeng on your way to the border.

I had a similar situation at Korat Immigration.
My paperwork didn't come back from BKK until 4 days after my "extension of stay" had expired.
Immigration said not to come for another extension until the paperwork came and they stressed I would not be on overstay.
When the paperwork came and I went to get the extension stamped in my passport there were several others who had been waiting past their "under consideration" date.

The current (2014) and the previous police order (2008) are written such that an extension based upon being the parent of a Thai are meant to be for a single parent.
The only difference between marriage and being a parent is the that the 400k baht does not have to be in the bank for 2 months. But there are some offices that want it to be in the bank for 2 months for both of them.
OK so it has changed since I was last issued with one in March 2012.
I will ask when I go next week for the 60 day extension if they will give me an annual extension based on my son.

The best way would be to contact them in person. I think they will allow joint custody.
If you had problems getting the new one year extension when the divorce is finalized you could apply for a 60 day extension to visit your child then do the one year extension before the 60 days end.

One of my income letters has been lost in the post and a replacement has been sent but I doubt it will arrive in time for me to get a letter of income from the British Embassy as they require 10 days to issue the letter.
Can I do a 60 day extension based on visiting my Thai child and then get an annual extension towards the end of the 60 days?
You can get the 60 day extension and the apply for the one year extension during the last 30 days of it.
If you are still legally married you will have to apply based upon marriage.
Far be it from me to contradict you but from about 2006 until 2013 I was on an annual extension based on being father of a Thai child whilst being married and living with my wife.
These annual extensions were issued by Korat Immigration.
The first extension was extremely difficult to get and involved a lawyer but I stood my ground, or rather the lawyer did, insisting that if the regulations stated that I could apply for an extension based on my child then I should be issued with one regardless of the fact I was married. After 6 hours of saying no the OIC allowed one the the other officers to call Bangkok for instruction and they were told it should be issued.
Maybe things have changed recently but I will try and get the extension based on my son.

I went to Chong Chom yesterday and went to the Immigration counter armed with my new and old passports. I was immediateky told that I had to go to the Immigration office in Kap Choeng as they could not transfer my last entry stamp at the border.
At the Immigration office they wanted the letter from the British Enbassy and the letter that sandyf refers to. They also needed photo copies of old and new passport photo pages, visa page and last entry page.
So do not go to the border at Chong Chom with your new passport unless you already have had your last entry stamp transferred to your new passport. If it has not been transferred stop at Kap Choeng Immi on your way to Chong Chom. The visa transfer is free.

Do I have to get either of these transferred to my new passport?
No
You will use both passport when you leave the country. Immigration will then transfer your last entry stamp to the new passport and stamp you out of the country in it. Then you will again use both passports on entry to the country to show your visa in the old one until the visa expires and they will stamp you into the country in the new one.

I got my British passport back in 12 days so I guess the backlog is over.
They may transfer your last entry stamp from the old to new passport if you mean doing it before you do another entry with your new passport.
The shouldn't ask for the letter to do that.

Korat has also stopped issuing letters of residence, for which they were charging 500 Baht. They say you have to get a yellow Tabien Bahn now. Not an easy task in the Amphur where I live.

Yes
An extension of stay based upon being the parent of a Thai can be obtained by a unmarried parent (divorce or death also).
I was told by a friend that Korat Immigration refused his 1 year extension of stay based on being the father of a Thai child when he tried to use the 40k pm option. They told him that he must have 400k in the bank.
The officer said that the 40k pm option was only available for an extension of stay based on marriage. Is this really the rule now?

What you could do is get a Multiple Entry Non-O Visa in Savannakhet Laos (based on that your Married to a Thai National).
No need to show funds to get this, but you need to do a Border Run every 90 days instead of going to your local immigration, this will give you an extra 15 months
Near the end of your 90 day entry you can go to your local Immigration office and get a 60 day extension based on visiting family. So you only need to do a border run every 150 day. The cost of the extension is 1900 Baht.

Don't wish to quibble UbonJoe..but...You do NOT need a Tabian Baan to get a passport. All you need is an ID card. Sure you need a Tabian Baan to get an ID card . My children have offered up their UK passports at Swampy with a departure card and never been asked either why they do not have an entry stamp nor asked if they entered Thailand on a Thai or other passport. TBefore there used to be a stamp in their Thai passports 'Seen at BKK' last time came in a month ago does not even have that. The airline is only interested in whether they have the right to enter the UK or a visa/passport to enter Thailand.
You are wrong on more than one point.You do not need Tabian Ban to get a Thai Passport. Does your child have a Thai ID card? You need a House registrationto get that. It does not take 5 days to get a passport; 24 hours to have it delivered. There is no reason you cannot leave on your UK passports. If you leave on the Thai passports, without UK passports then there would be a need for visas for the uk, which is obviously nonsense, if you have UK passports. Children cannot overstay, and I have never heard of a problem with 'expired Thai passports' . As far as I know there is no regulation that requires you to enter and leave on the same passport. Much of this does not add up!

Without a house book registry the child would not be able to get an ID card.
It is a requirement to leave on the same passport you entered on. There would be no entry/permit to stay stamp in a foreign passport if you tried to leave on a different passport.
Since the child entered on a Thai passport they must leave on a valid Thai passport. Their UK passport does not have an entry stamp in it.
Anyway on a different tack..who in their right mind would bring a child to Thailand. or anywhere, with a passport that was due to expire? It is a normal part of life that to travel anywhere that the passport must have at least 6 months duration remaining
And..this child has a Thai passport already, so it is just a renewal....
As a matter of interest, how does a Thai child get an ID card under the age of 15?
It is mandatory for all Thai children aged 7 to have an ID card. My son got his through his school.
I believe my wife had to supply the school with our Tabien Bahn her ID card and a copy of my passport photo page and current extension of stay.

I agree with you Saman, but I hope that some of the why, why, why? questions will be asked.
Then at least the Commander will be aware of the many inequitable situations that the current immigration rules present.

The major problem for myself and I am sure many others is the total lack of security we have visa wise if the unforessen happens..
I am a 64 year old Brit married to a Thai and have a 9 year old "Leuk Kreung" son. I have lived here on and off for 11 years and permanently since late 2009.
We have a lovely house in my wife's village, a car, 3 motorbikes a MiniMart near home on 10 rai and few plots of land ranging from 1 to 33 rai. All paid for by me with money bought in from the UK and totalling in excess of 30 million THB. Add to this the many millions I have spent in my time here on givimg my family a nice standard of living and you will see I am fully committed to living in Thailand.
Yet all this is worth nothing if Immigration change the requirements for me to stay here and I cannot meet those requirements.
In my country my wife would have had British Citizenship long ago just for being my wife and the mother of a dual Thai/British son.
I cannot apply for Permanent Residence as I do not work and pay imcome tax here.
Why after 11 years of marriage do I still have to meet finacial requirements to stay but cannot include the assets we have accumulated, over the years, with money bought in from overseas, and the income we get from them?

I have a friend who needs to activate part 2 of his Double Entry Tourist Visa at Chong Chom later this week.
His current passport has his visa exempt entry from Swampy, 2 out/in from Chong Chom and his Tourist Visa from Vientienne which he used to enter at Nong Khai a couple of months back.
Has anyone, in a similar sitution, experienced any problems at Chong Chom recently?

Usufruct has been mentioned as a possibility by some posters, however I believe to remember said in some of the usufruct treads at TV-forum that an usufruct agreement cannot be done between a marriage couple, need to be made before. Perhaps only some Land Offices are not accepting it, but do check the post in the usufruct treads – or perhaps some other forum members can verify or correct me.I think you shall check the usufruct posts before consulting a lawyer, as it has also been mentioned that some lawyers knows only little about usufruct. The paperwork should be fairly simple and costs next-to-nothing to register at the Land Office.Another thing about usufruct in my opinion is – but that is looked at through a very dark mind as “worst case”, however we do hear some horror stories – that one shall always be worth more alive in Thailand than dead.The suggestion about having a child with Thai nationality to be owner is certainly a possibility, a minor can own both land, property and stocks, and nothing can be sold or disposed against the child’s advantage, which also means that a usufruct may not be possible; as mentioned in the post above that may give some rights until the child is 21 years old, however a question about who is guardian for child…
I have been told by a Thai and a Farang lawyer that any contract between husband and wife can be cancelled by a court.
I have a Usufruct on our house and my name is on the Chanote. I also have Usufructs on a couple of plots of land again my name is on the Chanotes.
My wife finds it very hard to say no to one of her brothers and her elder sister so I insisted on Usufructs to stop these Wastrels pressuring her into putting the Chanotes up as security for their benefit.

He said he believed that customer behaviour in the pay-TV business was similar to that in the telecom business, where people prefer prepaid service to post-paid. So the company expects only 20-30 per cent of its new customers to choose the post-paid option.The only reason they want pre-pay customers is because of the total failure of their Accounts Department.
I signed up with them last August and despite several phone calls asking where the bill was by November I had still not received one.
Mid November they had a scolling message continuosly running at the bottom of the screen on some channels which my wife said was about billing and that if I did not contact them by the end of the month the service would be suspended. I phoned they took my details and said a bill would be sent within 15 days.
Needless to say no bill arrived so I phoned again and they said wait your bill is coming. Finally on the 20th February my bill arrived but for January and February only.
I have not received a bill since but pay the monthly subscrption the 20th of the month.
Mr Chirdsak is talking out of his backside, the reason CTH want pre-pay customers is their woeful inadequecy in getting bills to their post-pay ones.
Agree, on screen programming is a joke, shockingly bad and even worse than TRUE, web page is not that user friendly as well. I also think the signal strength is lacking and programme interruptions too frequent due to low signal.
When I asked why the signal was poor and kept failing I was told it was due to heavy rain in Vietnam

You can get a Usufruct which gives you "ownership" of the house for your lifetime. Your name will be on the Chanote.
It means that you have the lawful right to use the house and land.. Your wife still owns it and can still sell the house but only with you in it.
It is a pretty simple process and can be done at the local Amphur offices.
Search the forum there have been mahy threads about this in the past

They will not deny the extension. They may have you come back with additional documents.
Once the the application is accepted the final approval is done a the regional headquarters during the under consideration period.
The only report I can recall of one being denied was because all the money was taken out of the bank before the approval was done.
But you could go out for a non-o if it was denied or apply for a 60 day extension.

You can only get a Non Imm 'O' from a Thai Embassy or Consulate.
At the border they can activate an existing Visa or issue a Visa on Arrival which is good for 15 or 30 days depending where you are from.
