BTW, That looks pretty much a very close copy of the railing on my Condo in Toronto (24th floor).  

All this Physics and Math babble about height of balcony, height of woman and her centre of gravity,  width of railing, and penis/thrust angles  being spouted by so many could be explained  away if the police find a footstool in the condo.

No, it cannot be explained away by anything - since he has made statements to police already.  As such he is locked into the story he has given.  If he omitted something in the story that he later tries to include in his story -- because his original story is shown not to be a reasonable explanation...  his original statements can and will be used against him - including omissions.  He will then have to answer additional questions on why he was dishonest in his first statement (which in itself is incriminating).  That raises the bar on any other explanation being able to be considered reasonable.

 

Even if you introduce a stool into the equation - were their two stools - one for him to raise him up, one for her to raise her up - or were they both on the same stool and then he picked her up further....  then the question - is that reasonable - and why would you stand on a stool.  Remember the statement is that "they" came to an orgasm, unless he was ALL legs and no body -- her on the stool and having sex where "they" (not he, not she, they) came to an orgasm.... that is the statement he is locked into -- any change from there would likely be taken as a sign of guilt.

As stated earlier. Ask him to clearly draw a picture of the position. If he draws a stool fine if not then take him to the location and ask how its physically possible. Either way it has happened and she has died due to negligence thus can face up to 10 years in Thai prison and face a fine of up to 200,000 Baht. Given his previous convictions in his home country I would think the sentence will likely be near maximum time.

If you are now saying that no one should post their opinions about the case (or for that matter anything else) - this thread would be 25 pages smaller.  The fact is that for the most part we are just commenting on the work of the police so far -- since they were the ones that identified the person of interest, they are the ones that brought him in for questioning, and it was them (or more likely the prosecutor -- since this is a serious charge) that felt the appropriate charge based on primarily his statement alone (at this point) -- warrants a negligent homicide charge.  Police tend to charge with the evidence at hand, and while the investigation is ongoing -- the evidence would likely only be additive to the base charge that they submitted.  The discussions on what we are each of us think the sentencing will be is just really an estimated guess - based on the law, and any additional information that is available to the judge to use for sentencing.  This is after a discussion board - which by the very nature solicits facts AND opinions - in hopefully a mature and open discussion.

It is precisely such a misunderstood and unnecessarily long post without any kind of value for the case that contributes greatly to the fact that we soon pass 30 pages - this for thought when the writing itch for real puts in...;)

 But you do prosecute on Motive (stolen phone, drug use, fight not wanting to pay a pro) and Opportunity (tick). At best he could hope for would be Manslaughter. Either way I hope he gets what’s coming inside, he better remember the one rule in prison, don’t drop the soap.

i think he will end up paying off the family and the police . end of story.

Actually you can -- it is basically what you do when you convict someone on circumstantial evidence.  Each piece of circumstantial evidence on it's own is not enough to convict -- you basically theorize about all the circumstantial evidence and how all together can only lead to one reasonable conclusion.  Like any theory, it can never be proved -- only proved beyond a reasonable doubt....  but if another theory can reasonably explain the situation -- then you have to pick the lesser of the two reasonable explanations ...  (which if it one theory fits and it the in that theory they are innocent - they are found not guilty.

 

There are a lot of people in prison in western countries -- put their by circumstantial evidence.

This guy is certainly not an unfortunate first time criminal despite his young age...

Where would he get 5 million baht, he couldn’t even get a visa to stay in Thailand legally.

Comedy platinum because as cat handler says he couldnt even afford to stay legal on the visa front. Clearly selling drugs for an existance as well. Give him a 30 stretch to deter others

His local paper in the UK is saying he is still locked up in Thailand according to Thai police and evidence is still being collected.

 

It also notes he has an outstanding warrant in the UK.
