BANGKOK — A hospital that allegedly turned away a fatal acid burn victim will sue the press for defamation, its legal representative said Thursday.

Wallapha Chaiyamanowong, Praram 2 Hospital director, and her lawyer Surapat Praphaporn, held a news conference in which they vowed to press defamation charges against media that reportedly published false reports about the incident. The hospital is under fire for allegedly turning away Chorladda Tarawan, who died Saturday from acid ingestion and burns after being attacked by her husband earlier that morning.

This is one law suit that will get lots of press coverage. Along with blanket coverage of any misnomer, such as buildings not authorised, allegedly done by the hospital.

Is this what the hospital wants?

The sad thing is, I doubt they care. It's a government hospital, many who go there just don't have a choice. And the hospital gets funding bad press or not.

Lawyer ready to fire more shots at hospital

Accuses Praram 2 of falsely getting NHSO reimbursements, bribing rescue workers; Hospital denies it was ordered closed.

OUTSPOKEN lawyer Atchariya Ruangratanapong yesterday said he will testify against a Bangkok private hospital, which was accused of denying treatment on November 9 to a now-deceased acid-burn victim.

The lawyer is expected to deliver his testimony to a Public Health Ministry-assigned committee on Monday.

Atchariya also said he would lodge a complaint with the National Health Security Office (NHSO) to check on the hospital’s alleged use of villagers’ names as patients to get reimbursements and allegedly bribing a rescue foundation’s ambulance driver to deliver emergency patients to the hospital.

Meanwhile, Praram 2 Hospital director Dr Wallapa Chaimanowong, at this week’s second press conference yesterday, dismissed as untrue a report that the hospital was ordered closed for 15 days by the Department of Health Service Support (DHSS) due to a lack of quality or standard.

She said the hospital will exercise its legal right to sue social-media users and news agencies for publishing such false information and causing damage to the hospital’s reputation. She also called on the public to wait for the investigation results on Monday, regarding the hospital’s handling of the acid-burn patient.

As for news about DHSS ordering the hospital to close its outpatient building – which was modified from a carpark building without permission – and improve facilities within 15 days or face licence revocation, the hospital’s lawyer Surapat Prapaporn said this matter had nothing to do with the patient-related allegations. He said the hospital – which has been operating for 20 years – had legally modified the building and was submitting documents with the Public Health Ministry to prove that.

Atchariya, meanwhile, said the ministry-assigned committee – which will also hear the hospital’s defence on Monday – will decide on that very day if the hospital was guilty of violating the Health Facility Act regarding its handling of late acid-wound patient Chorladda Tharawan, 38, and what punishment should be imposed.

If the hospital is found guilty of breaching the act, its executives could be hit by a minimum two-year sentence in prison and a fine as seen appropriate by DHSS.

Other than testifying and filing a corruption complaint, Atchariya will also file a complaint with the Bangkok Metropolitan Administration (BMA) on Tuesday.

He wants the BMA to investigate the hospital, as he claims to have a list of people whose names were falsely used by the hospital to reimburse money as well as a document the hospital allegedly sent to rescue workers offering a bribe for patient delivery.

Meanwhile, Chorladda’s husband, 50-year-old Lop Buri native Kamtan Singhanart, was arrested on Sunday night under a murder warrant at his friend’s house in Nakhon Sawan.

He is currently under court detention pending police investigation.

I don't think it is a public hos[ital, a public hospital would not have sued for defamation for a start, the army or other government official would have made their presence known.

At first i was hoping for the best for this hospital; mistakes can happen and they should assist to find the truth, send condolences to the family of the victim, and if found they acted negliantly (which it seems they did by not having doctors available), they should get huge fines. But in the end I thought it would be best if the hospital would survive this for the patients and the hospital staff.

But now that they start suing everybody and everything talking negatively I hope this hospital will be closed, this director will be sued for everything she has, and the rest of the owners will not see one baht back of their shareholdings. Too bad for the hundreds of staff working there, hope you will find a new job soon.

This hospital is need of a crisis management/PR expert. Their every action seems to dig themselves into a deeper hole. Every day brings fresh missteps and misstatements. It boogles the mind how this director has managed this situation.

Maybe doctors in Thailand think the hippocrates oath equals hipocrisy, and so feel no moral obligations. I was admitted to a leading hospital, and parked somewhere without medical attention awaiting credit clearance. Meanwhile, a young, feverish, obviously very, very ill, boy stumbled into the ER and asked to see a doctor. The doctor asked if he had money on him, and where his Mum was. The boy replied his Mum told him to go to the hospital, and that they were poor people. The doctor never even examined him,  told him to go to a government hospital and told a nurse to escort him out the door. I offered  to pay, but had no cash on me awaiting credit clearance. It was the most hearthbreaking, cruel thing I have ever seen, and I can still vividly remember it 16 or so years on. I am generally totally unimpressed by the medical care service in Thailand.

Sorry, I thought it was a private hospital, the deceased lady wanted to go to a government hospital where she held a gold card for treatment, whatever that entails...

"It's a government hospital...".

It's not, the hospital doing the suing is a private hospital.
