In the original story it was mentioned the tourguide was Chinese, therefor illegal as a tourguide. And yes, a tourguide on the water has to be yellow class, and bears responsibility.

Would agree with you if it was a group of 5 year old kids not a group of grown up dumbasses from China .

 

Try to open an exit door on the airplane and sure as hell crew does not get charged the dinbass who opened door gets charged.

 

This is just common sense for a grown up, engine still running , do not go near the engine.

 

captain may well have advised to remain sitted until boat docked, fact that only one dumbass jumped would suggest all others were waiting

LOL...Ok, so they're illegal but have to be accredited yellow class, more likely they're not any class at all.

Seems to me it should be:  While on the boat the captain and crew are the ones in charge, and are totally responsible for safe operations, including full monitoring and very fast remedial reaction where needed, the tour guide should only be passing information given, but is responsible to ensure all the passengers have received the information and directions and understand them.

 

I added the additional words in bold italiques.

 

In this case I therefore support charging the whole lot and also the boat owner, who is receiving income from the boat being used to ferry paying customers and therefore has safety responsibilities. 

 

Until Thailand gets to see, understand and sincerely implement the whole picture, every time, nothing will change. 

 

I added the bold italiques for a further reason, before retirement I supervised many organizational projects for a number of large and medium Thai companies, often that included going right back to more specific goal aligned outputs on job descriptions.

 

There was often a brick wall from the CEO, the HR manager etc., 'don't want to sue words like responsible and accountable, sounds too serious and not polite to the job holder'.

seems simple but when the idiots operating the boat have no idea on how and what to instruct, then what do you do???
