Rimmer
Ex-legal chief files defamation charge against masseuse who accused him of extortion PATTAYA:--Pattaya’s former top lawyer has filed defamation charges against a Jomtien Beach masseuse who publicly accused him of masterminding a plan to have municipal police extort hefty bribes from beach vendors to fund a New Year’s party. Sretapol Boonsawat, who headed Pattaya attorney’s office before taking over the head of a Jomtien Beach massage association and becoming an advisor to current Mayor Sonthaya Kunplome, denied all accusations by Pakjira Wuthiphan that he pushed club members to pay city hall regulatory officers up to 20,000 baht to pay for their holiday party. He said the accusations, leveled on cable television, were false, damaged his reputation and brought public ridicule on him. Defamation, if proved, can carry a penalty of up to two years in prison in Thailand and a fine of up to 200,000 baht. A group of municipal police were suspended late last month and Sonthaya ordered an investigative panel immediately probe the complaints brought by the beach vendors. spidermike007
He said the accusations, leveled on cable television, were false, damaged his reputation and brought public ridicule on him. They are more than likely true. And this coward, does not want to face the consequences of his actions. A half man, using deflection, rather than taking responsibility, for his own actions. To save face. And why? Face is no doubt, the greatest form of weakness, a human can engage in. Many will say it is societal, cultural, etc. No matter. It is the absolute and complete lack of the ability to introspect, and look within for the source of any problem, shortcoming, conflict, or issue. It is the polar opposite of spirituality, and therefore an absolute scourge on Buddha, and all of the precepts he taught. By practicing face, you are denying your spiritual heritage. You are refusing to man up. To take responsibility for your actions. If a man or a woman cannot, and will not take responsibility for their actions, the problems they create, the mistakes they make, and the issues they involve themselves in, what are they? Are they still an adult? Are they a complete individual, if they allow themselves to be limited by such infinitely small social convention? Who cares what people think of you? For those of us with high self esteem, it just does not matter. Sure, close friends and family. But strangers on the street? Who gives a rat's butt about this? It means nothing what they think, nor what they say about you. They count for nothing. They are just people, and people you do not know, nor will ever see again. Face is rife with self doubt, and by subscribing to this weakness, and man or woman is made a far lesser person. For those of us with high self esteem, we know who we are. What others think, what society thinks, what a guy or gal thinks, means less than zero. Real men or women, simply own a situation, and take responsibility for their errors or mistakes. Small men, social deviants, or emotional adolescents deflect, obfuscate, attempt to confuse, and do everything in their power to deny that they made a mistake, or that they are responsible in any way, or on any level. They make up narratives about fake news, or alternative facts. Anything to avoid looking within, for the source of the problem. Anything.

biggles45
Sadly even if he did it, and it can be proven he did it, the truth is not a defence against defamation in Thailand. Thats why it is so popular with politicians....!

Just another indiction of the weakness, of contemporary Thai society, that is allows laws like this, which protect the rich and powerful, and prevent the outing of creeps, thieves, corruption and malfeasance. Any coward can hide behind the law. I can think of someone close to home, back in the US, who has been doing that his whole career. It does not mean it is right, and it does not say alot for the legal system.

IAMHERE
Can prison time be the end result of defamation law or is it strictly civil and monetary rewards ?
Rimmer
54 minutes ago, IAMHERE said: Can prison time be the end result of defamation law or is it strictly civil and monetary rewards ? Criminal defamation. Section 326 of the Thai Penal Code provides that a person who imputes anything to a third party in a manner likely to impair the reputation of another, or to expose such person to hatred or contempt is guilty of defamation. If the publication is made in a visible or easily reproduced manner, such as through print, video, and recordings, then an offender can be incarcerated for up to two years, subjected to fines of up to 200,000 baht, or both. In addition, charges of defamation, if lodged against a company, will also extend to its directors, regardless of their involvement with the allegedly defamatory statement.
