Twenty two year old "An" (an assumed name) said she was with three friends on Jomtien beach opposite Soi 14 when they were approached by a man who said he was a Filipino tourist. He said he wanted to sleep with her and offered her 2,500 baht for an all night experience. She had her doubts but decided to get on his motorcycle and go to his hotel. But instead of going to a room he took her to Pratumnak Hill where he tried to drag her into an area beside the road. She resisted but could not fend him off and he raped her, she said. He then fled on his bike, reported Ruk Siam News on Facebook. She went back to her room where a friend urged her to file a police complaint in an effort to catch the man. But what's a reasonable punishment? Is this rape and should it be handled like any rape where the woman did not agree to anything? There should be, and maybe there are, different kind of crime accusations depending on what happened. It seems she voluntarily went with him and they agreed already to have sex. The only thing which changed was the location of their activities. Should that be called rape? I have my doubts. And just to make sure there are no misunderstandings: I think everybody who raped someone else should go to jail. But it should be clear that the raped person did not voluntary join the attacker. This constitutes a verbal arrangement/contract. He broke the contract by taking her to another location & tried to force himself on her that constitutes rape !
