Soooo. why does anyone bother to try and enter the US the hard way. In that logic, everyone can just say they are asylum seekers and stay for years while the courts argue about it. No need for visas anymore.

Thats the law. Doesnt matter how they come in. Can fly in, go to imm and claim asylum.

 

Yes, if you do not want to go through the visa process you can claim asylum. There may be certain repercussions of a failed asylum request though. A failed visa request not so much.

You'd be breaking the law to do so. Crossing borders without the proper paperwork is a crime.
