Residency certificate + visa suggestions

Recommended Posts

Hi

I've recently married a Thai woman and moved here from the UK.

She owns her own apartment and has her own business in Thailand.  I am staying with her and as such don't have a rent agreement or landlord letter as such for the residency certificate (as required documents) does anyone know what we could use instead?  I've opened a bank account at UOB already with the address I'm living with her at, would that suffice?  My aim of the residency certificate is to ultimatley get a drivers lisence ASAP once I get the certificate.

Onto the next point, I'm currently on a 30 day tourist visa and have made one trip out of the country since arriving for another 30 days.  I was going to try and get a 30 day extension, and will have a job interview in Jan for a position so hopefull will be able to get a work permit from that.   In terms of long term visa, I was wondering what people would advise here.  My wife isn't keen on the spouse visa as we haven't signed a marriage certificate in thailand (in order to not have to do a prenup), but we have signed a marriage certificate in the UK already.  She has said worst case scenario she can get a work permit for me through her company, but doesn't want to resort to that (her company is a trading co., I work in the medical field so they aren't really linked, and her family are keen for me not be seen as smootching off of her).

I was planning on getting a non-immigrant business visa once (if) I got the job offer but that won't be until late Jan at this rate.

The other issue is I would like to get a multiple entry visa if possible, since my wife loves travelling and usually we go abroad 3-4 times a year so it'd be a pain to reapply for a visa 3-4 times a year.  Is there anyway to get a multiple entry business visa?

As the owner of the condo she has to declare you as resident in her condo.

You have to go together at the immigration office in the condo area and fill a TM30 form.

She can charge the form from internet  https://immigrationbangkok.com/thailand-immigration-forms/

the immigration office ask also a copy of her id card and condo book (I think its a blue one)

but the best thing is to phone the immigraiton office and ask first the list of requirments.

The sooner you do it, the better is.

After that you can have your residency certificate with no problem

but afaik you can't get a thai driver licence if you have a tourist visa.

For the visa you can extend your tourist visa until you are able to get your job

but since you are married to a Thai you can also try the O visa based on marriage

Things you need to know about the Thai marriage visa:

  • Thailand marriage visa is the popular term for "1-Year Extension of Stay Based on Marriage".
  • This is a long term Thai visa issued to a foreign national who is married to a Thai and meets the other requirements of the immigration bureau.
  • The Thai marriage visa holder is entitled permission to stay for a full year in Thailand without the need to exit the country.
  • The visa is renewable every year and the renewal process can be done inside Thailand (requirements for the visa renewal still apply).
  • The Thailand Marriage Visa also allows the holder to work in Thailand when the visa holder is able to obtain a valid Thai Work Permit to go along with the visa.

This is considered an advantage to prospective foreigner employees as the employer would only have to be concerned about the procurement of work permit.

QUALIFICATIONS

  • Must be married to a Thai national

This is substantiated through a Marriage Certificate. There are instances (depending on the processing immigration office) when a copy of an Affirmation of Freedom to Marry is also required. This affirmation is obtained by the foreigner from his embassy in Thailand.

  • Must meet the financial requirement
    • Security deposit of THB 400,000 in a Thai Bank Account for at least 2 months prior to the visa application; or
    • Monthly income of at least THB 40,000. A letter from the foreigner embassy has to be shown to verify this income

Supporting documents as proof of the security deposit in a Thai bank are as follows:

    • Updated bank book or passbook
    • Bank letter stating that the money had been deposited to the account from an overseas source for not less than 2 months.
  • Other documents that may be required to be presented:*
    • Police Clearance
    • Medical Certificate

* These are not required if the visa application is submitted inside Thailand, though there are rare occasions, however, when an official from the Thai embassy or consulate may ask for these documents before issuance of the visa.

THAILAND MARRIAGE VISA APPLICATION PROCESS

Please note that there is no direct application for the Thailand marriage visa. It is important that you give proper attention to the requirements and other factors surrounding the entire procedure to eliminate possibility of unsuccessful visa application. The basic guidelines when applying for a marriage visa are as follows:

  • You must obtain a 90-day visa or a 1-Year Non-Immigrant O visa from your home country or country of residence prior to your application for the Thai marriage visa. (The 90-day Non-Immigrant visa may be obtained from nearby countries in Thailand.)
  • Once the non-immigrant visa is obtained, you must travel to Thailand to activate the visa.
  • You must prepare all needed documents for the conversion of your non-immigrant O visa to marriage visa.
  • The extension will take place on the last 30 days of the 90-day permit to stay.
  • The visa extension application is submitted to the Immigration Office with all the necessary documents for the visa application. The processing period may take about a month before issuance of the Thai marriage visa.

Additionally, the foreigner on a Visa Exemption stamp or a tourist visa can still apply for a marriage visa given that the foreigner has already met the requirements for the non-immigrant O visa and for the one year extension visa applications. This can be done at the immigration office in Thailand.

REMINDERS TO THE THAILAND MARRIAGE VISA HOLDERS:

  • 90-day Reporting

This is needed once you obtain a marriage visa. Notification with the nearest Immigration office about your current address or residence is required every 90 days.

If you are not in the country when the report is due, the counting of 90-day period before your next reporting will start again after upon re-entry to Thailand.

  • Re-entry Permit

If you plan to travel in and out of Thailand during the year of your visa validity, you will need a multiple re-entry permit to do so and to avoid your visa from getting cancelled. Otherwise, you need not apply if you plan to stay in Thailand the whole time.

In case you find the need to leave the country for whatever reason, you can apply for a re-entry permit at the nearest Immigration Office or at the international airport before leaving the country.

  • Bank Account

The marriage visa is valid for a year and can be renewed by presenting the same requirements during the initial application. Please note that the required amount of funds in your bank account must be at least 3 months old before your can renew your visa.

In the event of divorce, the validity of your marriage visa will be forfeited and you will have to leave the country immediately. In some cases though, you may be allowed to stay in the country until your current marriage visa expires.

You can read some of the topics on the forums

and also some of the members are much more qualified than me to answer to your questions

so consider my message just as a first information, wich need to be completed and\or corrected

you are legally married in another country, you can only get married once, you have to register your marriage at the local amphur.

you can get a 60 day extension instead of a 30 day one for reason of visiting Thai wife. you can get a multi entry non imm 'O' visa from savannakhet no financials required and the wife does not have to be with you, it requires an overnight stay.

if any of this is repeated from post number 2 above i apolgise as that post is far too long to take in. one thing i did glean for that post is it refers to a 1 year married to Thai national extension as a marriage visa, that is not correct, also funds have to season for 2 months not 3, and the extension is not forfeit on divorce, they may be other errors

That is not a official website and has a lot false and misleading information.

To OP you are are already married for certain things since your marriage in the UK is recognized here for certain things.

You can get single and multiple entry non-o visas based upon marriage and 60 day extensions to your wife by showing your UK marriage certificate.

To prove your residence you can use your wife house book and ID card to prove your residence with a short statement from your wife that you are living with her.

For the TM30 form she can complete and submit it since she is the owner. Only copies of her house book and ID card signed by her.

If want a one year extension of stay based upon marriage you register your foreign marriage at an Amphoe to obtain a Kor Ror 22 marriage registry to apply for it at immigration.

Do you know where you got it (which part of Thailand)? It sounds like every place plays by its own rule, I was going to go to the one in BKK as I live there and use Fatboys service as insurance as I need a drivers lisence asap

Buriram. It is probably a bit more flexible place than the main cities. Also no issues to get a thai bank account with tourist visa.

In what year was it? It seems to be a recent requirment

you cannot obtain a Thai driving licence if you are on a 30 days exemption

(It was a mistake of my part to write ''tourist visa'' my meaning was for a tourist

with an exemption of visa)

Last year. Also I didn't have to do the tests. I had a UK B,C licence (car, lorry). They wouldn't give me a truck licence but I got an A (motorbike) and B (car). The whole process took about an hour and a half. I had to get a residency certificate beforehand from buriram immigration , cost me 700 baht for 2 copies (one for car one for bike)
