Sanook reported on a Facebook post after an accident in Chaiyaphum in Thailand's north east saw two people on a motorcycle come off as a woman was crossing the road. 

 

The woman appeared to stop to allow the motorbike to pass but then raises her hand.

 

The media said that both pedestrians and riders need to take care to avoid accidents. This incident happened outside the Ratchanon shop.

 

Here at Thaivisa we are asking for your take on the accident. 

 

Who was to blame - or do they both share responsibility?

In most parts of the world that have traffic laws, jaywalking across a street is illegal unless there is a well marked cross walk. Sometimes it is allowed if distance to corner to cross is too far, distance depending on local jurisdiction. We can't tell from the video how far her crossing point may be from legal crossing point, but barring that, I'd say

The woman is at fault

Pedestrian primarily at fault.

 

She walks out into the road regardless of the on coming motorcycle clearly expecting the motorcycle to stop.

The motorcyclist doesn't stop but anticipates the woman will continue walking out, changes his path towards the center-line to go around the woman, who then stops. The motorcycle has to adjust again. The woman puts her hand out in protest, strikes the rider and and those on the bike fall off.

 

The motorcyclist could have stopped, the mistake the motorcyclist made was not stopping and assuming the woman wasn't going to behave like a dumb tool. But it was the woman who walked out into traffic.

But the bike also appears to ride towards her (in the middle) instead of past her.

I wouldn't be surprised if something had happened before the clip.

It appears she took  a-swipe at them but she was stood still, bikes fault.

Perhaps she thought she was in Vietnam! From my experience, to cross roads in busy Hanoi, you "raise" your hand into the air and start to cross - believe it or not you will get to the other side! It is a recognized signal.

It likes like the motorcyclist had already swerved to the right anticipating that the woman wouldn't stop.

The woman hesitated and stopped in the middle causing the accident.

 

Motorcyclist could have / should have stopped. The woman should never be crossing the road until its clear.

 

BUT... thats the way people cross the road in Thailand. Cross 1 half, then stop, look the other way and cross the other half - very very stupid on a road which doesn't seem that busy.
