Arrested because of overstay.

Hello. 

One friend of mine was  arrested at transported to IDC Bangkok. 

 

So question is what is the way to bank transfer or someone should come and visit him in  DC to him get some money?

 

How it's works there?

There are MANY personal accounts regarding overstay.

I suggest you Google something like "overstay and IDC Thaivisa" much better than search using Thaivisa search engine.

Your can transfer the money online if your friends has a Thai bank,  How much money are we talking about?

Abused? Obviously he didn't even use the visa system, which is why he is on overstay.

They were certainly on a overstay before March 26. Which means the amnesty does not apply to them.

Why? 

If he was on overstay prior to the amnesty, he should be sent straight to IDC.

Hey,  yes I contact  his Switzerland embassy and let them know about situation. 

 

His visa finished before 26 March that why him get arrested and get to IDC. 

 

Now I collect money to my account from his friends / family / etc for him can buy ticket and pay fine. 

 

But IDC is itln Bangkok and I stay at Ko Chang and him no have Thai or any account with him. 

 

So that's why I ask I need to drive to Bangkok to visit him directly or there have some another system to him can get this money. ( I mean  some bank transfer to IDC etc)

An immigration lawyer would do it I'm sure, probably not gonna be cheap though.

His embassy should be able to receive and give him the money. Most will do it.

If you know somebody willing in Bangkok they could do it.

Be very careful, I would not transfer it to IMN, if it is lost then what will you do? Better to talk with the embassy to see how to pay. Always get receipts

If he is Swiss the embassy will provide consular assistance and if he is truly destitute provide an advance payment against him signing a guarantee that the money will be returned to the government once in Switzerland.

 

There is no need to suddenly scramble for money and pay "fines" let alone trying to pay off officials. Let the professionals deal with it. While unpleasant he'll survive a short period in IDC.

 

Isn't the max fine just 20,000 THB?

As indicated by @ubonjoe, coordinate your actions with the Swiss embassy. If you wish to provide your friend with some comforts (such as better food) the embassy can probably use money you provide to make this happen if they are motivated to do so. The most important task will be to get through all the formalities so he can be deported, and then pay his fines and for the flight to Switzerland. The flight is pretty expensive at the best of times, and may be even more so now. An immigration lawyer can probably do little to help (except possibly speed up the process a little). They simply add to the expense.

That's at the airport departing. 

As I understand it he will go to court and the fine will be much less. 

After court date he will need obtain airline ticket and will eventually be taken to airport with escort. 

It's not going to be cheap process. I hope his situation was not due to lack of money. Since if he is skint then has issues.

OK. I will contact Embassy again. 

 

Him have court in Trat 5 days ago, so I don't know will be one more in Bangkok or not.

Can only assume his overstay was prior to the 26 March 2020 if he has been arrested so he will need 20,000 baht which is the maximum fine for overstay .

OP.... Please do not travel to Bangkok to try and see your friend in IDC.  You will not be allowed to visit him.  The only people allowed to visit a detainee are: Thai officials, Embassy officials, representatives of approved charities, appointed lawyers, parents/spouses/relative of the detainee. 

 

As several TV members have already stated you, or the person's relatives, should seek the assistance of the Swiss Embassy Consular staff and send funds to your friend via them.  FYI - IDC will normally informed his Embassy of his whereabouts within 24 hours of his arrival at IDC.

 

As has also been mentioned, his stay there in IDC will not be very comfortable/pleasant but it can be improved slightly if he has money available in an 'account' that can be set up by the Embassy staff with the IDC to enable him to purchase better food, toiletries etc via the guards. 

 

He will also need adequate funds in his IDC 'account', or a credit card, to enable him to purchase a flight ticket back to Switzerland.  The ticket will be expensive because a one way tickets is often the same price as a return ticket fare and may be more so due to limited flights because of Covid-19.  Do not try to purchase a ticket for him, this must be done via a travel agent approved by IDC who will also need to co-ordinate with IDC staff to arrange transport and escort from IDC to the airport prior to his departure.

Seem to recall your very across this issue from previous threads.

Do you have any guesstimate to the "hidden costs". Regarding transport to Bangkok (think he is currently Trat). Then of course from IDC to airport.

With many flights out being cancelled, it will be tricky. 

Reports in AU news of folk repatriating back to AU (not deported) being "advised" to purchase business class+ to ensure ticket.

Btw is this an anomaly applicable to Thailand that a detainee scheduled for deportation has to pay for his own flight? Usually deportees are put on a plane and "shipped out", paid for by the government.

 

How long do they want to keep a person in jail if there is no money to buy a ticket?

As far as I'm aware, Immigration offer three classes of transportation namely:-

 

Economy Class

 

Business Class

 

VIP Class (Free internet provided)

Not sure if they have meters fitted, but even if they do you can bet your bottom dollar they wont be working so price will be negotiable.

 

Sorry I just could not resist.  To be honest, I have no idea if they charge for transport but as you said there is possibly some hidden cost.  I will ask my wife's friend the next time we meet.

FYI.....  Under the Thai Immigration Act B.E. 2522, Chapter 6 - Deportation of the Aliens, it clearly defines that the offender shall bear the cost of the conveyancing to their home country.

 

If a deportee does not have access to funds to purchase a ticket they stay in Thai Immigration Detention Centre in Bangkok.  I am reliably informed that there are people have been stuck there for years and their governments are unwilling to offer them any form of financial assistance to enable them to return to their home country.  It's a case of 'rot in hell'.

In unusual times with covid.

There have been many folk at various stages of planning for options when amnesty ends. Some saying I can stay 89 days avoid a ban and pay 20k at airport.

Good luck with that plan.
