Thus, he could be classified as being an ‘over stayer’ and face risk for overstay penalties. He should definitely not risk checking into a hotel with an expired visa in his passport. There is always a risk for him to be caught, whether it is at the hotel or walking down the street. Thus: Checking in at the hotel presents a risk that Immigration is alerted. Whether Immigration choose to respond to any alert in a timely manner is a complete unknown. The only known factor is that your ‘friend’ is potentially placing themselves at greater risk by potentially involving ‘other people’ in the knowledge of his overstay. Then have more big problem than think how long ban going to get. He get 1 year ban if less than year overstay! If they caught him outside airport he can get 5 year ban.
