george
Owner of free picture-hosting site arrested BANGKOK: -- Police arrested the owner of a free picture-hosting website after police traced pictures of a woman having sex with her ex-boyfriend to the site. Siriporn Suwanpithak, 26, was arrested at his company in Pathum Thani. He said he did not know that his site, www.212.cafe.com was used to host the pictures of the woman. The woman has filed complaints with police that her ex-boyfriend distributed her pictures taken while having sex with him on Internet. The ex-boyfriend has been earlier arrested. Police traced the sources of the pictures and found that they were hosted on Siriporn's free-service site. -- The Nation 2008-05-

frenchFARANGbkk
Interested to learn Thai law about this, anybordy can help ? Thanks.
Briggsy
Pay up, confess or be charged and held on remand for months until found innocent possibly years later. If option © is chosen, receive 200 Baht a day for your imprisonment. That's about it for many people. The law is what the police says it is. zorro1
Had a look at the site and it is not a porn site and IMO was a one off. Feel sorry for the guy http://video.212cafe.com/video.php?category=rd&viewtype=
a2396
Ho, Hum. One of my "sweethearts" boyfriends had scads of Porn on her computer and her phone, which I presume he downloaded or shot himself or originated from other "locally produced" sources. Never saw her face in them though, so not sure it was her. I think he was selling some of this to Thai boys "in need".
The Vulcan
...The woman has filed complaints with police that her ex-boyfriend distributed her pictures taken while having sex with him on Internet... Funny how the omission of punctuation alters the meaning - "he distributed her pictures (what pictures?) which were taken whilst having sex with him on the internet (how do you do that?) i.e. have sex on the internet? Cyberstar
the owner of the site really responsible?? Although not an expert on the wording of any country's law - common sense tells me: Of course he is! - After all, the owner of the site is the actual publisher, isn't he? - I would even go one step further and say that the website's hosting provider is in grave danger of also being held responsible - at least by Thai authorities - assumed the illegal material has been uploaded to his very harddisk (should the website just link to material located elsewhere the situation may be different). indiefan
I know nothing of Thai law. In Canada the owner of the site would never be held responsible at all. Providing a service that can be used to break the law is not breaking the law. Otherwise, google would be shut down.
Seneque
that's what i call : being unlucky There are zillions of sites providing women having sex ... and this guy is arrested !! If the 'ex' girlfriend had her pictures taken while doing it ... she must had known what was coming !... Anyway the whole 'internet' thing is getting basically 'out of hand'

In a multitude of countries, your assumption would be incorrect. The person primarly responsible would be the person placing the content in question there. The hoster/site owner is secondary responsible, depending on country ofc, if he fails to remove the content after due notice (see: DMC).
Scott
I feel sorry for the poor guy (the one hosting the site). I also wonder why people let other's take pictures of them having sex. There is always a chance these will fall in the wrong hands.
Wolfie
i would have thought that providing the host provides a report function to allow users to identify questionable material, he would be given a certain amount of leyway to get offending materials removed before he would be prosecuted. That certainly makes the most sense. However this particular case has a lot more to it than what we are being told.
Briggsy
My! Who will be arrested next? Using the logic applied in this case, it could be the administrators of Thaivisa!!!!!!!!!!!!
Junglejumbo
Obviously with a free pic site, the major risk is pornography which is clearly illegal in Thailand. There are also privacy laws in most developed countries, so this site could have still broked laws even if it was registered overseas. I think the owner just didn't didn't think too hard about risk. Was bound to happen and probably has before now, but this time he got busted.
sweetchariot
Haven't you ever heard of cyber sex ?? there are many people that have cybersex cam to cam. I tried it once, but I couldn't find the right hole. Plus the fact the casings of my PC's give you those nasty little electric shocks, so you wouldn't be wanting to put your wanger anywhere near there Anyway the whole 'internet' thing is getting basically 'out of hand' Says the guy posting about his ex's porn expolits on an internet forum!
