It is hilarious that foreigners start from the premise that is it ok for them to flaunt the laws of Thailand by setting up an illegal structure to hold land unlawfully and then cry foul when the Thai authorities catch em!

If you don't want to lose what you have then start at the outset obeying the laws of the land.

There are legitimate ways to control land and property in Thailand, pay the minimum of tax and sleep comfortably at night.

However if you listen to your mates and shady characters, and if you are not prepared to pay for professional advice and assistance - do as Stevie Nicks sings ... "Go your own way" (and perish!)

Certainly they are entirely legal - in terms of compying with the laws of the land. The concept of ownership is flawed - and there are various ways to control properties, companies and individuals. Most major international corporations employ teams of lawyers and investment bankers to structure their holdings.

There is no reason why anyone can't do exactly the same - but at a fraction of the cost. But if you are hoping for the K.I.S.S. solution -forget it. The solutions are complex and involve legal compliance to be effective. That is why they are legal. Anything less would be ineffective and unsatisfactory.

the day before the general election blame it all not on the local ruling class, but on those pesky foreigners - so confused voters would cast their vote on the status quo and "social order" parties.

nationalistic frenzy is the best way to divert an attention from the real (and not an imaginary) social issues, like poverty and lack of justice.

kun sriracha is a good lapdog of the army, that's why he was appointed a member of Constitution Drafting Committee back in 2007, why he got a cushy job in the one of the most corrupted governmental departments and why he has spoken now about the foreigners

What if it isn't big talk, but reallity?

All those companies with so called partners ?

I think only the poorest under the farangs gave it to their lady (so they have notting to begin with),

de rest is stuck with his company and ........is going to loose it and deported .

Airplanes will be full !

Economy in the costal sides will schrink to ........lets say 1%? Or are the cheap charlies worth more ?

The rest will be deported..........

Ones they have their land back .....the land is worth notting ,becouse the people with money are not longer here !

Back to stone age .......thats what the mighty people really want.......much easier to control the poor masses !

Restricting land ownership only benefits the wealthy of any nation. To the people that cannot own the land, it matters little the name on the title.

Could easily be argued and I think supported, the more land ownership is diversified, the better it is in general for an economy.

Its never about doing what is right or fair in Thailand. Always the grabbing hands, enough is never enough.

Land cannot be taken out of a country. These laws only benefit the wealthy Chinese and Thai elite.

Who cares - Phuket is so 90s anyway...

Thank God I moved out of LOS after 12 years there.

In Europe and USA Thai's buy land own land and businesses 100%, they can do whatever a local can do without paying anything more for that. They can even ship money out of the country without any hassle. After a few years as a law abiding tax paying immigrant they can get a new nationality.

Why do the Westerners (Falangs) do that? Well they see any immigrant who work and pay there taxes as a valuable member of the society who help build up the wealth of that particular country.

Surely we have an amount of Thai's who come and commit crime, contribute nothing and the like. However these few elements speak for themselves and do not represent the rest of them, hence the laws and attitude is positive until you as a person proves this wrong, then you are penalized and not your race or creed. Thailand signed a document where this is supposed to be the law of the land in Thailand too, however they do not adhere to the document they signed, it basically is not worth the paper it's written on, it was just another lie to the rest of the world to look good on paper without meaning or doing as it states.

The Thai racist laws is a sign of fear, incompetence and not understanding economy. That said however the Thai economy and country seems to float along whatever stupid stuff there government comes up with. Float along is the word as there is a huge amount of poverty, and it is still an underdeveloped country. Had the leaders managed the country better had the entire Thai population done much better, to hide incompetence by spreading fear of foreigners, confiscate land and deport investors does nothing good for the nation and it's people. Some rich people buy up the land dead cheap underhand from the confiscating department. Some few get greased palms and a rich man get a steal. Then they aim for next cycle of idiot foreigners who buy, invest, build up and throw them out. It has worked before and they believe they can continue this forever. As long as foreigners put there money into the nation they will continue. The development suffer, the population suffer and the foreigners suffer. Who cares some white uniform got greased and a rich person got richer.

Thailand in my humble opinion has too many ignorant selfish people, and a very bad attitude for right and wrong. It is a great place to go for a short holiday when ignorance is a funny story when you return home, but I would never live there again until they change the laws and attitude. The day you actually can live in peace without fear for the government there I can see a massive leap for the nation and it's people, until then they will float along as a banana republic.

Is a Thai wife considered a nominee? We have a house (in her name), and simply have to put into writing that all the money used to buy the house comes from her, so I have no claim over it. But to secure the bank loan, they take into consideration our combined income!

Anyway, the guy is a xenophone and he's talking out his ...... The sad thing is 90 percent of Thai will believe him - who's going to question the poo yai?

The cumulative effect of this had been a growing problem of land ownership though Thai "nominees", he was quoted as saying in a Thai-language report on the state-run MCOT website.

Yeah those pesky Thais in the UK Im sick of em buying all our land, actually many Indians own it by the looks of things when Im back home.

Anyway the plans good, now who will decide where all the proceeds of grabbing this land back will go???? no opportuntiy there for anything .........move along.....

Would not worry too much. A foreigner cant be prosecuted for buying land through a nominee, it is illegal for the Thai nominee to buy it on behalf of a foreigner, and only the Thai nominee can be prosecuted.The land code (s113) only makes it a criminal offence for the nominee.

LAND CODE BE 2497

Section 113. Any person acquiring the land on behalf of the foreigner or the juristic person under Section 97 or Section 98 shall be liable to a fine not exceeding twenty thousands Baht or imprisonment for a term not exceeding two years or both.

Of course land held on behalf of a foreigner can be seized and sold by order of the Interior Minister, so you lose the land, but it is not a criminal offence.
