Everyone's circumstances differ, but in this statement i have covered all the criterior that will be needed for success. I am sharing this as to hopefully make thing's a little easier for anyone that is or in the future going to go down the defacto partner route. I will add my partner's statement later, when i find time. Re; application for XXXXXXXXXX Thai P.P. number:XXXXXX My name is XXXXXXXXXX Australian P.P. number: XXXXXXXXXX Address XXXXXXXXXXXXXXXXXXXXXXXX To whom it may concern Dear sir or madam I am writing this statement in support of XXXXXXXXXXX partner visa appliction.I am XXXXXXXXX de facto partner and have been since the 14th june 2010. History of our relationship I first met XXXXXXXXX on the 14th of Dec 2009 whilst on holiday in Thailand we met in the oishi buffet restaurant in central festival shopping centre Pattaya, where XXXXXXXXX was working at the time, there was an attraction on both sides, and i eventually asked her out for dinner. Over the next few days we struck up a close friendship that quickly developed into a relationship. For the remainder of my holiday in Thailand we were inseparable and XXXXXXXX ended up staying together with me at my hotel. I returned to Thailand to visit XXXXXXXX on the 4th of june 2010 and this time XXXXXXXX invited me to live with her in her appartment in pattaya for the duration of my stay. In this time we also travelled to Hua Hin for a 2 week holiday. Our relationship grew very strong and we took our relationship to the next level. On the 14th of june 2010 is when we started living as de facto partners, from this time we truly are commitment to a shared life together to the exclusion of all others. From ths date i also took on the emotonal,physical and financial responsibility of supporting XXXXXXXXX and her 2 daughters XXX (XXXXXXX) and XXX(XXXXXXXXXXXXX). I returned to Australia on the 28th of june 2010 due to work and travel commitments. Whilst in Australia we kept in constant contact daily via phone calls and i also started to send money to help with the support of her 2 daughter's with schooling and everyday life. I returned to Thailand at the first opportunity that my work would allow, to be with XXXXXXXXX again on the 28th Jan 2011. This time we travelled to XXXXXXXXX's home village in Na Duang Loei province, and met her daughters and family. XXXXXXXXXX family made me feel so welcome, and they also arranged a small party where our relationship was blessed by family and friends in the traditional Thai Buddhist way, XXXXXXXXXX 2 daughters then returned to pattaya with us we took them to Ko larn and restaurants and we generally got to know each other better. XXXXXXXXX applied for and was granted a 3 month visitors visa to Australia and she returned with me on the 27th of Feb 2011 XXXXXXXXX and i spent a wonderful 3 months together in Australia, XXXXXXXX lived with me at my address XX XXXXXXXXXXXXXXXXXX. Some of the things that we did were , visiting with my family and friends eating at restaurants, sightseeing, fishing,shopping and a short holiday together at surfers paradise on the gold coast. On the 22nd of may 2011 XXXXXXXX returned to Thailand due to visa requirements. And i stayed in Australia due to my work commitments, It was a very sad time for us both as we had no choice but to be apart for a short period of time. XXXXXXXXXX moved back to Loei to spend time with her family and i supported her and her daughters by transfering money from my bank account to her bank account. Whilst we were apart we kept in daily contact and maintained our relationship with each other by phone,txt messaging,emails and windows live video calling. I returned to Thailand at the first opportunity that my work would allow,to be back with XXXXXXXXX. this was on the 27th of Oct 2011. I lived with XXXXXXXXX for 1 month in Thailand and in this time she applied for her 2nd visitors visa this time for 6 months and this was granted. We returned together to Australia on the 25th of Nov 2011. XXXXXXXXXXX and i spent another wonderful 6 months in Australia together and she lived with me at my address at XXXXXXXXXXXXXXXXXX. In this time we shopped together for household item's made a garden in my backyard together , one of the many things we love to do together, went fishing and catching crabs together, sightseeing visiting some of the local attraction's in my area ,We spent Christmas with my family at my brother XXXXXXX house, went camping with my sister XXXXXXXX and her family ,and also a short holiday at port maquarie. On the 20th of may 2012 we will be returning to Thailand together, and we will be living together at the time of XXXXXXXX lodging her application for a partner visa. I would just like to state that we are very much in love with one another and our de facto relationship is genuine, and i have added a statutory declaration to support this. We have attached further evidence of our relationship in the evidence folder; copies of letter's of support of 2 previous visitors visa's. Evidence of travel together.... Evidence of socialising together.... Evidence of phone call's email's and video calls Evidence in bank statement's of; transfer of money from my bank to XXXXXXXXX ,payment's of house hold goods, and shopping. Photos; showing our social life ,Our time in Australia and Thailand,and photos around our house . Evidence of joint bank account Periods of seperation My job in Australia does not allow me to travel to my partners country to live there for extended periods. We have been in a de facto relationship for a total of 24 months and lived together for a total of 13 months. In the previous 12 months before XXXXXXXXX lodging her application we have been living together for 8 months. Our relationship in time of seperation has been maintained by daily telephone calls to each other and internet video calls, Evididence of this can be found in the document and evidence folder attached to her application. At all times we have both been commited to a shared life. Financial aspects We have opened a joint bank account together, and we both have access to this account at all times.(evdence of this is in the evidence folder attached to application) I have been supporting XXXXXXXXX and her 2 daughters, with schooling and everyday living since june 2010(evidence of this is supported in transfers in my bank statements and our joint bank account in the evidence folder attached to application). We have been shopping together for household goods together T.V. bed , washing machine and general food shopping (evidence of this is shown in my bank statements in evidence folder attached to application) I am currently employed by XXXXXXXXXXXX in manufacturing. My wage is approximately XXXXX per year. i have been employed by my current employer since march 2004. My wage allows me to live reasonably well in Australia with an excess of income over expenditure. I am already supporting XXXXXXXXX and her 2 daughters and am confident that i can show i am able to support XXXXXXXXX in our home in Australia. She wishes to seek employment in Australia to enable her to contribute to our financial circumstances, I have attached to her application my payslips ,bank statements and a term deposit confirming my ability to provide for my partner without recourse to any welfare payments The nature of our household XXXXXXXXXX and i when living together in Austalia have been living at XXXXXXXXXXXXXXXXXXXXXXXXXXXXX We share the cooking of our meals as we both like to cook, but when i am working XXXXXXXXXXXX always prepares my lunch or dinner, As i am working fulltime XXXXXXXXXXXX generally does the washing of clothes,vacuming ,washing up and housekeeping, I do the lawnmowing, and work that need's any maintanance, We both work in our small garden where we grow various fruit and vegatable's for ourselves wich we both love to do together.(photos attached in evidence folder) We do our grocery shopping together. social context of our relationship Statutory declarations from friend's and family have been attached to XXXXXXXXXXX application supporting our relationship as de facto partners as well evdence of hotel stay at surfers paradise, invitations , temporary membership of clubs where we go for dinner and fishing licences we purchased on the same day.Also attached is evidence of joint travel. We have also attached copies of some letters i have sent to XXXXXXXXXXXX adress in Thailand as well as medical insurance that is adressed to our home in Australia. The Nature of our commitment to each other I would like to state our commitment to each other is 100% and we are in love with each other, and further more i will support XXXXXXXXXXX 100% emotionaly, physicly and financialy and evidence of this can be seen in itemised phone account's that show daily contact with each other in periods of seperation. We have been in a relationship for over 2 years now and we have knowledge of each other's personal circumstances (background and family situation). Our future plan's together We both wish to live as man and wife in Australia, returning to Thailand periodicly to visit with family. XXXXXXXXXX is going to seek employment in Australia when her visa is granted. We also have plans to one day buy a house of our own in Australia. We have also talked about having a child together. We wish to live a happy and loving life together forever. I thankyou for taking the time to read this statement. I trust that we have been able to provide sufficiant evidence that we are in a genuine and continuing de facto relationship and i am able to fully support my partner in our home in Australia. Did your partner apply for a 'Partner Visa'? What class of Visa is a 'Defacto Visa' ? Did your partner apply for a ... Partner Temporary Visa (Subclass 820) Permanent visa (subclass 801) Partner Temporary Visa (Subclass 309) Permanent Visa (Subclass 100) Prospective Marriage Visa (Subclass 300) ... or something else ? Hi David The visa issued is a partner provisional (subclass 309) applied for on defacto ground's. The permanent visa(subclass 100)application is also included in the same application and will be issued after a review in 2years from the date my partner lodged the application 13/06/2012. Hi spoonman I assume by your reply your missus visa was a visitors visa ,no need to mention where and where u met (i certianly did not on a visitors visa) But you will have to give this as evidence of your relationship on a partner visa. For what it is worth my supporting letter for the missus' visa application just outlined my ability to support her during our visit, visa application was successful. To be honest, it doesn't matter if you did meet her on a chrome pole. There's plenty of people on TV who are married to ex-bar girls etc. There's heaps of paper work for partner visa's but once you get the documentation. they're pretty easy to get. Nice work. If you were to ever apply for a partner visa,she would actually qualify for a permanent visa and be able to bypass the provisional permanent visa as you have been in a defacto relationship for over 3year's, Also you could use your past letter's of support as evidence. 1 Link to comment Share on other sites More sharing options...

nightwatch Posted December 4, 2012 Author Share Posted December 4, 2012 (edited) Hi all I posted earlier that i would add my partners statement that she wrote for her partner visa (subclass 309/100).Statement's from both of us are a requirement for the partner visa. This was not easy for her, although she can speak reasonably good english, putting pen to paper to write a statement was a different matter, and she insisted that she could not do it. I told her that it is needed for the visa and she had to try, so with her upset i left for work, when i got home she had written out a couple of page's for the statement ,it had taken her all day using a thai translation book. The statement she had written did not contain all the criterior but i thought it would be better to add it to her application the way it was with some very minor adjustment's on her spelling. I just typed out her statement and got her to sign it. Here it is. Statement for de facto partner visa application xxxxxxxxxxxxxx I am xxxxxxxxxThai P.P.number xxxxxxxxx I wish to be with xxxxxxxxxx forever because i love him. I see xxxxxxx first time 14 dec 2009 in oishi restaurant. I work cook in there in central pattaya shopping,xxxxxxxxx ask me for go dinner, Thereafter we go together nearly a month we go see movie xxxxxxxx he is very romantic man. I Love he.
