With a Thai Elite visa can a person work legally as a digital Nomad ?

Thailand doesn't seem to want the digital nomads unless they setup a company, employ people, and pay taxes. And the "B" visas will probably come under scrutiny once they go that route.

We have no real rights here, and definitely don't see immigration making exceptions for them.

Thailand isn't interested in busting these digital gypos or whatever they are called. Selling fake designer stuff on ebay. Thailand just wants them to cough up the cash for a non-imm visa which they all seem very reluctant to do.

the vast majority of "digital nomads" are not nomads at all, they are working through shelf limited companies in places like HK and other places, and they are working on line to clients in their own countries and invoicing company to company to offset/minimise personal tax payable in their own countries or so they can be paid by their "clients", as some clients will not pay indivduals directly for on line work in their own countries due to taxation issues unless you have a legal entity set up, ie a limited company or similar vehicle

How many people do you know that the above actually applies to?

I personally know dozens of digi nomads in Thailand and have connections with scores more.

None of them fall into the above category.

They are nearly all one man and his laptop making his own living in life. They don't work for or through any companies in foreign countries and very few have clients of any sort.

This is what I'll do when I go back to the UK or a European country tbh and I think it's pretty common.

Set up a company in HK (where you don't pay tax on money you earn outside HK) and just pay myself a wage when I'm living in UK for more than 3 months of year.

Why should I pay full tax when Google, Starbucks, and Amazon can get around it cheesy.gif

I would do the same in Thailand too if they wanted to tax me on my earnings, which I'd be totally fine with paying.

It's a shame people from the US can't do stuff like that, but I do know people with companies in HK who don't pay any tax on the first 100K they make per year when they're living outside US.

There's absolutely no reason for them to pay tax in Thailand as they get no benefits from Thailand.

I pay tax here as do a lot of legitmately employed people and get no benefit either in Thailand, so why should digital nomads be treated any differently ?

No one in their right mind wants to pay income tax anywhere, but its a part of life

as I have suggested before, the simple most workable solution in this instance would be

forego the 4 employee route

set up a THB 1.0m or THB 2.0m Ltd liability company

seeing as the work is done over seas in most cases, 20-25% provisional tax/withholding tax

pay into the Thai SS security fund

pay for private medical insurance

annual fully independently audited books

costs of annual WP & visa or extension

= Non Imm B & WP

going this route would only require one change to immigration/business law ( 4 X employees)

any other "new" visa type requires changes to immigration/labour and business laws, which aint going to happen

fake designer stuff on ebay, "professional" gambling on line, porn sites, these are some of the reason's why there will never be a "digital nomad" type visa/set up simply because it cant be controlled as what some one gets up to as regards running an on line "business"

That's not a very nice thing to say considering the unsavory stuff people could say about in/outers (which I think you are?)

This allows me to travel as frequently as I want and to work legally in Thailand.

you really have a Elite Card? 1. there is no Thailand Elite Visa, 2.. if you really have a WP you dont need any Elite Card,

you can travel how often you want, only thing ist to have reentry permit,

many times I asked the big guys who claimed to have a elite Card (5 times more peopel claim to have one than been sold in Thailand the last 5 years) come on and post a picture of your visa, you can blacklist your personal data, but come on all your elite Card members, show that you are not talking bullshit

There have already been pics from people with the Elite Card Visa in ten different threads. And you claim they don't exist.....are you 12 years old or ?

A Digital Nomad can be any person, it's a very wide group of people, At the beginning I am not consider my self a Digital Nomad because the first time that I learn about this name was 99% associated to haughty bloggers. (and probably the ones eating noodles in a cheap fan room)

A digital nomad is just an alternative step after working from home, some people will create their one business and deep roots, others will improve their skills and big wings.

I met poor and rich ones, young and older, from every place, but all depend on the skills that you have and the possibilities are unlimited but the start is bloody difficult.

And about illegal stuff it's the same with any regular work, scams in Thailand are older than the internet era and is not a problem related to immigration, visas, or foreigners, the real problem is the corruption, Thai or foreigner with a lot of money is likely to do wherever that they want, the Elite card is just a 'legal' example, but what about Kao San Road cards, documents and all the rest of offers like in my thaivisa inbox, stop being so mean with digital nomads is like a digital racism just because you can't understand, open your mind wai.gif

I'm not sure if there is a connection between someone who deals drugs and someone who decides to run a business from a website instead of a physical store.

Weren't you the guy that mentioned selling stuff on eBay? Yeah, running to the post office to collect bulk supplies and running out again to ship them one by one sounds like an online business to me whistling.gif

C'mon dude, surely you can say the exact same thing about a plumber or an electrician who runs around fixing homes off the books.

A digital nomad is just someone who sells services, physical products, or non-physical products online.

I bet George from TV could run his business from anywhere making him a digital nomad.

Yeah, you do get people who sell pyramid schemes, etc. But like I said, there are bad apples in the online and offline world.

The fact your painting the entire online world in a negative light through ignorance isn't very fair.

What are you talking about? You do get a Thailand Elite Visa. And people have posted pictures of them. Quite a few people have purchased them on here.

there is not Thai elite visa, there is a thai elite membership card, but anyway you have to make a visa at

Thai Embassy, because the only places who can give you a visa is a Embassy or a Consulate, nobody else,

and in Thai Law, what i think is vallid here in Thailand there is no Thai Elite Visa written in the kinds of visas

and i still wait for the links and picture of the ELITE VISA

so can you read the official statement? According to TPC president, Apisit Chuenchompoo, the lower projection was due to the country’s political turmoil since last year including the miliary coup last May. “The situation therefore impacts on tourist and investor confidence,” he reported.

So far, the company sold 41 Elite Card memberships, meaning it has now to sell 276 membership to hit even its revised target with just three months left of the fiscal year that ends 30 September.

they sold 41 EliteCard all over the world but hundrets of TV member claim they have one, and it is only a membership and not a Visa!

It's not up to me I don't make the rules. If you are a one man biz it's easy to get a non-imm visa. Although your visa doesn't allow you to work but work is usually defined as actual work. Making money is not the same but I'm not a lawyer.

You can thank all the small timers for causing these visa problems. Making a few hundred bucks a month online and doing too many entry stamps.

If your biz is legit set up a company and have a representative office in Thailand then you don't need Thai staff.

I must be a real Thailand Elite member using a fake visa (or some sort of baseless childish assumption of that kind)...

For those who still don't believe how great is the Thailand Elite program (for some at least), I don't know what else to post :)
